* Prayer or Relief Sought This appeal contains the PDF document in three pages. Its first page is the report of circle officer Lalganj dated 23/07/2021 which explicitly shows that charge sheet in the matter concerned has been submitted before the competent court which means investigation in the matter by the investigator Dinanath Yadav is over. Now police may provide the investigation report as sought by the information seeker under point 4. Second and third page of the attached PDF is communication of the Circle officer Lalganj dated 11/07/2021 addressed to the information seeker.The Concerned public information officer may provide the posting detail of the investigation officer Dinanath Yadav still awaited as sought under point 4. X ray report made available by Government Hospital Sonebhadra must be made available to information seeker which is part of medical examination report. Undoubtedly, apex court of India says arrest is not necessary under section 325 of the Indian Penal Code as stated by police concerned, but it does imply that police must not arrest the accused under section 325 and apex left it to the discretion of police concerned. Here police blatantly misused its discretionary power caused promotion of criminal elements ipso facto.

Punishment for voluntarily causing grievous hurt.—Whoever, except in the case provided for by section 335, voluntarily causes grievous hurt, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. Warrant cases are those that include offences punishable with death penalty, imprisonment for life or imprisonment exceeding more than two years. The criteria that differ a summons case from a warrant case is determined by the duration of punishment in any offence. C.O. Lalganj submitted the same report in concerned matter whatever complaint submitted by the aggrieved people even when contents of the grievances were changed. In the matter of serious allegations of corruption, whether it is sufficient ground to leave the alleged person that complainant pressurizing the investigator to arrest the offenders. Think about the credibility of the concerned 1- No photography was carried out of the place of the event by the investigation officer even when he reached to the place incidence after the incidence. Moreover, whatever blood samples were available on the ground that was subverted by the police itself instead of collecting the evidences. Three serious assaults made by offenders, two are in the record of the police and one criminal incident was not registered by police arbitrarily. Fourth criminal incidence by the offenders committed by grabbing the land which has been reported to police concerned but no action on the part of police. Serious injuries inflicted by the offenders on the head, eyes and broken arm, but police still remained insensitive acted like judge to languish the case which promoted offenders. The matter of 10 April 2021 was registered under section 323 and 504 of Indian Penal code was later converted by investigation officer into 107/116 of criminal penal code on both the parties. There are two types of evidences 1-Direct 2- Circumstantial. If C.O. Lalganj not interested to collect the direct evidences, then he must observe the circumstantial evidences exposing the investigation officer. Here investigation officer is only acting like catalyst to offenders which is the root cause of repeated assaults by the offenders on peace loving people and widow. Whether setup norms were followed by the C.O. Lalganj in checking and making enquiry into the matter of serious allegations?

ReplyDeleteजन सूचना अधिकार 2005 के तहत प्रथम अपीलीय अधिकारी उत्तर प्रदेश सरकार के शासनादेश के अनुसार पुलिस कप्तान रैंक का अधिकारी होता है और छोटे जिलों में पुलिस कप्तान पुलिस महकमा का सबसे बड़ा अधिकारी होता है अब वह तो राजा हो गया अब राजा जो है अपील थोड़ी देखेगा यही कारण है कि जन सूचना अधिकार के तहत कोई सूचना जनपद स्तर पर नहीं मिल पाती है
