* Prayer or Relief Sought From the Status of R.T.I. Communique, it is quite obvious that R.T.I. request forwarded to the concerned public information officer on 25/03/2021 and today is 30/05/2021 which categorically implies that PIO has violated the subsection 1 of section 7 of the Right to Information Act 2005. Think about the gravity of situation that government of Uttar Pradesh has nominated PIO to such an incompetent staff who does not know stipulated time as prescribed under subsection 1 of section 7 of Right to Information Act 2005. This is a humble request of the appellant to concerned appellate authority to recommend the government to appoint a competent staff at the post of public information officer and information sought by information seeker must be made available as soon as possible without any further delay.

If the government functionaries of the Uttar Pradesh are right and justified then they must provide the information as sought by the applicant. This is violation of the human rights of the aggrieved.

Here motive of the concerned public information officer is important because he has not forward the the application submitted under right to information act 2005 under subsection 3 of section 6 of right to information act 2005 as the the information was concerned with the other public authority and they did too much delay in transferring the RTI application to the other public authority which must be done within one week from the date of receipt of the application under right to information act 2005. This implies that concerned public information officer deliberately created the blocked in seeking the information by the information seeker.
ReplyDeleteIt is well established fact that action of the public information Officer department of forests government of Uttar Pradesh is a mockery of the provisions of right to information act 2005 but it is unfortunate that no accountable public functionaries in the Government of Uttar Pradesh will take action against this wrongdoer public information Officer belonging to the department of forest government of Uttar Pradesh.

(ii) the subject matter of which is more closely connected with the
functions of another public authority,
the public authority, to which such application is made, shall transfer the application
or such part of it as may be appropriate to that other public authority and inform the
applicant immediately about such transfer:
Provided that the transfer of an application pursuant to this sub-section shall be made
as soon as practicable but in no case later than five days from the date of receipt of the
application.

Here date of receipt is 25/03/2021 and transferred on 01/07/2021 which means after three months while maximum time taken to transfer the RTI Communique is 5 days but here more than three months.
