How can the government tolerate the illegal proceedings against the applicant instituted by the assistant labour commissioner violated entire setup norms in instituting the proceedings against the applicant on the request of a contractor?
From the beginning when the case was initiated against the applicant and the notice was served then applicant during the initial hearing objected the institution of the case by a contractor that the case does not stand against the applicant by a contractor but assistant labour commissioner arbitrarily overlook the arguments of the applicant which was a mockery of the law.
With this representation of the applicant there is 4 page order of the District Judge Mirzapur in which bail application of the contractor Yakub Ansari was cancelled by the District Judge Mirzapur in the same matter where the Yakub Ansari itself accepted the fact that he is a registered contractor but in the court of assistant labour commissioner he is saying that he is a labourer despite the objection of the applicant assistant labour commissioner is accepting the false affidavit of the contractor Yakub Ansari.
On the one side of a screen the applicant suffered huge loss because of the contractor Yakub Ansari but on the other side of the screen assistant labour commissioner illegally instituted the case against the applicant and now initiated the proceeding which is going going to be lengthy at the behest of the contractor which is not applicable under the Payment of wages act 1936.
Under the Payment of wages act 1936, only employees can seek remedy not employers as contractors are employers who employ labourers.. Which is the root cause Yakub Ansari appeared before the assistant labour commissioner as a Labourer. Actually he is a registered contractor, quite obvious from his affidavit before the District Judge Mirzapur.
Act of the contractor Yakub Ansari is tantamount to cheating which must be taken into cognizance by the assistant labour commissioner but he is not acting so. There are certain questions arising regarding the integrity of the assistant labour commissioner because of his cryptic and mysterious dealings.

Grievance Description-Quasi judicial proceedings initiated by the assistant labour commissioner District Mirzapur on the application of a contractor which is illegal and ultra vires to the provisions of Payment of Wages Act, 1936. An enquiry may be ordered into the matter to curb such corrupt practices rampant in the office of assistant labour commissioner District Mirzapur.
An application under Article 51A of the constitution of India to make enquiry concerning the working of the assistant labour Commissioner district Mirzapur.

How can assistant labour Commissioner district Mirzapur prosecute the applicant and his younger brother at the behest of Yakub Ansari considering Yakub Ansari as labourer? The applicant has submitted certain representations before the assistant labour Commissioner district Mirzapur that this case is the violation of the rules framed by the government of India as the case of the salary under the salary payment act is amenable before the assistant labour Commissioner only if the litigants are labourers.
