Grievance Description

Honourable Madam, you are quite right. On my piece of land, they will construct house and the piece of land lying in the side of my house belongs to them, some part of it is used by my family as a lane to come out of house, they will close it. We will suffer two losses simultaneously 1- Piece of land belongs to us. 2-After construction of house, they will close our road which passes through their piece of land. Thus, we will confine to our house which means we will be detained in their own house by the opposition party. How can such move be justified?

Consequently, they must separate our share from the controversial piece of land on which construction is stayed by the competent court. Otherwise, they may find amicable solution by providing us road by pursuing due procedure of law and we will cordially welcome their positive approach.

Moreover, Station house officer police station Jigna district Mirzapur may provide the reason of implicating the applicant under section 107 and section 116 of the criminal procedure code as it is blatant misuse of the provisions of the criminal procedure code by the police even after the obvious guidelines issued by the High Court of judicature Allahabad.

According to the circular issued by the department of home government of Uttar Pradesh dated 9th September 2021 which prohibits the misuse of the Section 151/107/116. of the Cr. P.C. which categorically states that misusers policemen of the aforementioned sections of the criminal procedure code will be panelised with the pecuniary penalty of the Rs.25,000. In the following report circle officer Lalganj did not provide the reason off implicating the applicant under section 107/116 of the criminal procedure code.

5- Summary / conclusion of the investigation:- During the investigation of the case in question, it was found that the applicant Ashok Kumar Maurya son of Murlidhar Maurya resident of Bihasra Khurd police station Jigna district Mirzapur has a farm (land) of opposition Gulab Chandra Maurya son Ramdev Maurya resident of Bihasra Khurd police station Jigna district-Mirzapur near his house and the farm (land) of the applicant is after the farm (land) of the opposition. Opposition leader Gulab Chandra Maurya has been barred from constructing a house in pursuance of the Honourable court order staying the construction of the house on filing a suit no. in the Honourable Court to stop the construction of the house by the applicant. Opposition leader Gulab Maurya has been apprised of the Honourable Court order. The applicant/Ashok Kumar Maurya told through telephone that the opposition Gulab Chandra Maurya has 06 brothers including him and has gabbed a piece of land of my share and when asked about the case in the court, he is telling that the suit no. 504/2023 has been filed in the court, which is currently pending in the court. The next date of which is fixed on 05.09.2023. Both the parties were told that the above matter should be argued in the court and get remedy. The applicant Ashok Kumar Maurya wants a way to go to his house above, over which the opposition Gulab Chandra Maurya is facing tension from the above. In view of the peace and order, action under section 107/116 CrPC has been taken by Jigna Police against both the parties on 27.07.2023. Due to the investigation and confidential information done so far, the allegations mentioned in the form are not being confirmed due to lack of evidence.
