Grievance Description

Quasi judicail proceedings initiated by the assistant labour commissioner District Mirzapur on the application of a contractor which is illegal and ultravires to the provisions of Payment of Wages Act, 1936. An enquiry may be ordered into the matter to curb such corrupt practices rampant in the office of assistant labour commissioner District Mirzapur.

An application under Article 51A of the constitution of India to make enquiry concerning the working of the assistant labour Commissioner district Mirzapur.

प्रार्थीगण/ अभियुक्तगण के विद्वान अधिवक्ता का यह तर्क है कि प्रार्थी याकूब अंसारी एक रजिस्टर्ड ठेकेदार है और जो भी काम किया गया वादी मुकदमा द्वारा नियुक्त सिविल इंजीनियर के कहने व मार्गदर्शन में किया है।

How can assistant labour Commissioner district Mirzapur can prosecute the applicant and his younger brother at the behest of Yakub Ansari considering Yakub Ansari as labourer? The applicant has submitted certain representations before the assistant labour Commissioner district Mirzapur that this case is the violation of the rules framed by the government of India as the case of the salary under the salary payment act is amenable before the assistant labour Commissioner only if the litigants are labourers.

This observation was made by the District and session judge Mirzapur while delivering the judgement in the matter in which the applicant is a victim. उक्त तहरीर के आधार पर फारूख अंसारी व याकूब अंसारी के विरूद्ध धारा-406, 420 भा०दं०सं० के अन्तर्गत मामला पंजीकृत किया गया है।

प्रार्थीगण/ अभियुक्तगण के विद्वान अधिवक्ता का यह तर्क है कि प्रार्थी याकूब अंसारी एक रजिस्टर्ड ठेकेदार है और जो भी काम किया गया वादी मुकदमा द्वारा नियुक्त सिविल इंजीनियर के कहने व मार्गदर्शन में किया है। प्रभारी नगर अभियन्ता नगर पालिका परिषद मीरजापुर द्वारा जो निरीक्षण किया गया है। उसमें किसी तकनीक का प्रयोग न करके मात्र आंख देखी बातों के आधार पर रिपोर्ट लगाया तथा वादी मुकदमा के दबाव व प्रभाव में आकर रिपोर्ट दिनांकित

In the court of Assistant Labour Commissioner District-Mirzapur, Uttar Pradesh Payment of Wages Act, 1936 Case number-P.W./01/2022 Prayer-Notice issued through letter number- 78-80 dated 27-01-2022 against Sudarshan Maurya S/O Brijlal Maurya and Sandeep Maurya S/O Brijlal Maurya is ultra vires to Payment of Wages Act, 1936 therefore liable to be quashed because based on the concealed and false facts of the case. More details are attached to this representation. Object of the Payment of Wages Act, 1936 The Payment of Wages Act regulates the payment of wages to certain classes of persons employed in industry. This implies that Payment of Wages Act, 1936 deals with the dispute between employer and employees but not between a contractor and a common man who had given contract to construct house to contractor Yakoob Ansari S/O Siddik Mia who is plaintiff number 1 in the aforementioned plaint. Yakoob Ali Ansari S/O Siddik Mia itself accepted in the complaint dated 07 June 2021 that he used to take contracts of the construction of houses. This implies that he is a contractor.
