Section 379 of IPC-According to Section 379 of the IPC, whoever commits theft shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. 

Since the local police set the offenders scot-free so they are threatening the applicant with dire consequences for making complaint against them. How the justice available to vulnerable section specially women and girls in the state of Uttar Pradesh if th police in the state will not register F.I.R. against criminals assaulting seriously.

The matter concerns the working of the station house officer police station Adalat who is not taking any action in the matter under the pressure of the gram Pradhan of the village panchayat which is unjustified and can never be accepted in good governance.

Subject-Procrastination by the station house officer police station Adalhat district Mirzapur in registering the first information report against the offenders in the matter which is reported to the station house officer on 19th September 2023.

Case details are as follows.

Place of tragic incidence-village-Ghurahupur, post-Pachegada, block-Narayanpur, police station-Adalhat, Tehsil- Chunar, district Mirzapur

Time of the tragic incident-6 o clock in the evening and date of it is 19th September 2023.

The Names of the offenders are as follows.

1-Manish S/O Munna, 2- Sandeep son of Vijendra

It is noticeable that both the offenders were in the police custody on the next day but it is most unfortunate station house officer Adal hat did not perform the proceedings of the first information report and both the accused we are set scot-free by the station house officer in cryptic and mysterious manner.

The brief description of the submissions of the applicant is as follows.

1-Both the offenders not only assulted the applicant seriously but they also snatched the gold ornaments worn by the publicant in nose and ears.

2-Right to reason is the indispensable part of sound administrative system therefore it is an obligatory duty of the station house officer who must disclose the reason why had he freed the offenders without pursuing the prescribed norms setup by the government of Uttar Pradesh in such matters.

3-Whether it is not reflecting the lackadaisical and corrupt approach of the station house officer in matters dealing with the criminal elements which will only promote corruption in the department.

4-Whether the derogatory remarks by the gram pradhan on the victim before the police is not the violation of the human rights of a woman? How can it be allowed in a police station which reflects only indiscipline in the working of the police?

5-How can it be justified that station house officer, police station- Adalahat may create undue pressure on the applicant to withdraw the case under the pressure of gram pradhan which is a mockery of the law of land and such practices must be curbed by the accountable staff in the department of police.

6-The treatment of the police in the police station Adal hat was the violation of the human rights of the applicant because they took under teeth the provisions of the law by making mockery of it who created not only embarrassing situation for a woman but also insulted her with their their derodatory and obscene remarks. Whether the police in the state of Uttar Pradesh regards the women in the state in such a way which is not reflecting a civilized society

This is a humble request of the applicant to the superintendent of police district Mirzapur to order and enquiry by a senior rank officer so that accountability can be fixed of the police personnel humiliating a woman seeking justice from them. O God help me.
