Grievance Description
The matter concerns the arbitrariness and tyranny in the process of regularization of the vulnerable staff under the supervision of divisional forest officer Gorakhpur which must be taken seriously by responsible officers in the government of Uttar Pradesh. Please restrain divisional forest officer Gorakhpur from anarchy.
An inquiry under Article 51 A of the constitution of India regarding the compliance of the provisions of notification of the Uttar Pradesh Regularization of Persons Working On Daily Wages or On Work Charge or On Contract. The objective of the applicant is to ensure the transparency and accountability in the regularization of the persons working on daily wages in the government departments in compliance with the notification.
The matter concerns the working of the divisional forest officer district Gorakhpur regarding the following notification issued by the government of Uttar Pradesh on 12th September 2016. GOVERNMENT OF UTTAR PRADESH PERSONNEL SECTION-2 NOTIFICATION Miscellaneous No.9/2016/2/1/97-Ka-2-2016 Dated, Lucknow, 12 September, 2016 IN exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of all existing rules and orders on the subject, the Governor is pleased to make the following rules: THE UTTAR PRADESH REGULARISATION OF PERSONS WORKING ON DAILY WAGES OR ON WORK CHARGE OR ON CONTRACT IN GOVERNMENT DEPARTMENTS ON GROUP C AND GROUP D POSTS (OUTSIDE THE PURVIEW OF THE UTTAR PRADESH PUBLIC SERVICE COMMISSION) RULES, 2016 These rules may be called The Uttar Pradesh Regularization of Persons Working On Daily Wages or On Work Charge or On Contract In Government Departments On Group C And Group D Posts (Outside The Purview Of The Uttar Pradesh Public Service Commission Rules, 2016. They shall come into force at once.
Divisional forest officer Gorakhpur says that the personnel working on daily wages or on work charges or on contract are regularized but the staff of the department are not directed to make the list of such personnel so list of regularized personnel under the notification is not available to the department.
This implies that there is no transparency and accountability in the regularization process of the vulnerable staff of the Department of forest under the supervision of the divisional forest officer Gorakhpur. Those staff providing services to the department for many years with dedication have been sidelined and the staff who are having money in their pockets are the front runners in the process of regularization so such practises must be curbed by the government of Uttar Pradesh by setting the standard norms which must be followed by the divisional forest officer Gorakhpur.
Think about the gravity of situation divisional Forest officer could not provide provide the list of the regularised candidates under the notification which means something is wrong in the process of regularisation being adopted by the divisional forest officer Gorakhpur which must be stopped and an inquiry must be ordered to check the anomalies in the process of appointment through regularization.
The applicant has sought 6-point information from the divisional forest officer Gorakhpur to ensure the transparency and accountability in the process of regularization of the vulnerable staff but it is most unfortunate divisional forest officer did not provide any information under 6 points which is quite obvious from the denial of information attached as the first two pages in the pdf document to the grievance.
If the government has not provided patronage to the divisional forest officer, then it is obligatory duty of the senior rank officers in the government of Uttar Pradesh to order an inquiry in the matter of regularization of the vulnerable staff of the Department of forest. The matter concerns the wide public interest so it is expected from the responsible officer of the state to take it seriously so that rights of the vulnerable section must be preserved.
