* Description of Information Sought As per Section 397 of Cr.P.C, the High Court or any Sessions Judge have been empowered to call for and examine the records of any proceeding satisfy oneself: as to the correctness, legality, or propriety of any finding, sentence or order, whether recorded or passed, and as to the regularity of any proceedings of an inferior court. Moreover, they have the power to direct the execution of any sentence or an order to be suspended. Not just this, but to even direct to release the accused on bail or on his own bond if the accused is in confinement. They may even order an inquiry subject to certain limitations. It is clearly evident that the appellant courts have been granted such powers so as to obviate any failure of justice. The information seeker is a 77 years old senior citizen whose health is not well enough to travel long distances. Following case Institute against my wife, son and me itself. The applicant filed the criminal revision which details are as follows. Daily Status District and Session Judge In the court of :DISTRICT JUDGE, BUDAUN CNR Number :UPBN010083962023 Case Number :Criminal Revision/0000190/2023 VIMAL KUMAR RASTOGI versus State of UP, Date : 11-10-2023 The next date of hearing has been fixed by district judge 27th October 2023. It is noticeable that despite the objection of my advocate learned judge/:IV ACJJD/AJM issued warrant against the information seeker and his family members. The learned Council for the applicant told the Honourable magistrate Court that revision application of the applicant has been admitted by the Honourable Court of the district judge but it was overlocked by the trial court. Moreover, the applicant and his wife appeared in person before the court of Honourable district judge it was told to the learned magistrate but he/she did not pay heed. Central Public Information Officer may provide the information to the information seeker if the parallel proceeding of the subordinate Court will continue how the miscarriage of justice will be curbed.
