Grievance Description

The matter concerns the working of the divisional forest officer Gorakhpur. According to the new transfer policy of the government of Uttar Pradesh class one and class two staff of the government of the Uttar Pradesh cannot remain posted for more than three years in the same district as well as they will not remain in the division for more than seven years. For the more details, vide attached pdf copy of the new transfer policy sent by the chief secretary Mr. Durga Shankar Mishra to the subordinates on 15th June 2022.

An application under Article 51 A of the constitution of India to make inquiry for curbing the violation of the provisions of new transfer policy in the working of the divisional forest officer district Gorakhpur.

The matter concerns the deputy ranger Mr. Jagdamba Pathak who is posted in the Baki Range in the division Gorakhpur for three and half years.

The brief description of the submissions of the applicant is as follows.

1- Mr. Jagdamba Patak is the in-charge ranger of the Baki Range for three and half years.

2- Right to reason is the indispensable part of the sound administrative system therefore it is expected from the divisional forest officer Gorakhpur to provide the reason for giving the charge to a junior rank officer for three and half years when the personnel are available in the government of Uttar Pradesh.

3- Whether the divisional forest officer Gorakhpur will provide the reason of violating the provisions of new transfer policy by posting the Jagdamba Pathak in the Baki Range for 3 and half years.

4- To provide junior rank officer charge of a senior rank officer for longer duration is a kind of corruption which must not be promoted in a good governance, but claimants of good governance will never meditate on such issues.

5- Think about the gravity of situation new transfer policy was brought up by the government of our chief minister Yogi Adityanath to promote transparency and accountability in the working of the government and control the corruption in the government machinery which was rising alarmingly but it seems that new transfer policy is being used to promote the corruption in the government machinery.

This is a humble request of the applicant to the Honourables to take action in the matter concerning with deep irregularity. For this applicant shall ever pray you, Honourable sir.

In the communication addressed to the chief forest conservator division-Gorakhpur, divisional Forest officer gorakhpur says that posting of the Ranger is done by the government. Which means it is the fault of the government which lacks transparency and accountability in transfer and posting of the personnel. How can a deputy ranger entertain the post of ranger for longer duration more than three and half years which is a mockery of the law of land? If the ranger was posted at the post then he had to be transfered from the post by pursuing the new transfer policy of the government. It is most surprising that the divisional forest officer is satisfied with this illegal act of the government. It is most unfortunate that he did not consider it fit to alert the government about this mockery of the law of land. According to his report if a forester may be appointed/posted at the post or divisional forest officer and he is working excellently then it is legitimate in his eyes.
