In the following grievance concerned, the investigation officer submitted an arbitrary and inconsistent report which is attached to this grievance. Whether the matter of the theft can be entertained by sub divisional magistrate sadar? It is quite obvious that police are escaping from the matter on false grounds, quite obvious from the report of the chauki in-charge and inspector of kotwali katra. Undoubtedly it is a mockery of the law of land which must be taken into account by the accountable staff of the department of police.

1-The applicant along with Harishankar Maurya S/O late Shitala Prasad Maurya went to Kotwali Katra police station district Mirzapur to register First Information Report in the matter of theft and representation in handwriting submitted before the accountable staff of the Kotwali Katra but he denied to take it and asked the applicants to submit this representation before the chowki in-charge. This incident took place today quite obvious from the first page of the attached PDF document to the grievance. 1-Right to reason is an indispensable part of a sound administrative system so it is obligatory duty of the concerned police to provide the reason for it. Kotwali Katra police refused to register the first information report in the matter of theft. The Public Information Officer in the office of the superintendent of police must provide the reason for it by accessing it from the working of the Katra Kotwali police.
Submission of the appellant-No information has been made available by the inspector of the Kotwali Katra under this point. No reason for not registering the first information report was made available to the information seeker as well as the report is not attached to this reply. Reasons are focused sentences while the reports are details of the matter so the report cannot be considered as the reason.
2-Please provide the number of theft cases registered in the Kotwali Katra police station district Mirzapur.

3-Please provide who will register the first information report in the matter of theft whether it will be registered in Kotwali Katra police station or in the office of chauki incharge.

4-Please provide the benefits in the procrastination in the registration of the first information report by the police as being done by the Kotwali Katra police station in the matter of theft. .

2-It is noticeable that earlier the applicant had went to the Chowki incharge to make complaint in the matter of theft then he asked that first information report will be registered in the Kotwali Katra, my Chowki is not a reporting Chowki so Kotwali Katra will register the matter then they will forward it to the Chowki for appropriate action which means investigation in the matter. But the factual position is that staff of the Kotwali Katra district Mirzapur did not register a First Information Report in the matter of stealing which is not setting up an excellent precedent and such practices will only promote corruption and Anarchy in the society.
3-Whether the lackadaisical approach of the police officers in the matter of stealing is not promoting the burglars so in the wide interest of Justice it is obligatory duty of the accountable staff of the department of police Mirzapur may take appropriate action in the matter so that Inspector Kotwali Katra may register First Information Report in the matter and start investigation to detain the burglars.
This is a humble request of the applicant to the Honourable superintendent of police district Mirzapur to take appropriate action in the matter which is questioning the integrity of the police in performance of the general duty which is required from them but procrastinating on it to support the burglars. Most respected sir please take action in the matter, for this applicant shall ever pray to you honourable sir.

महोदय जांच आख्या सादर अवलोकनार्थ प्रेषित है संदर्भित प्रकरण मे गहराई से जॉच किया गया तथा प्रभारी निरीक्षक कोतवाली कटरा से आख्या प्राप्त किया गया तो पाया गया कि आवेदक उपरोक्त पते की निवासी है जॉच से ज्ञात हुआ कि आवेदक का ग्राम बसई टप्पा 844 परगना कंतित थाना विन्ध्याचल, तहसील सदर मिर्जापुर के अराजी नंबर 331 रकबा0.51 में आवेदक का नाम बतौर सहखातेदार पर नाम से अंकित है जिस पर उपरोक्त आराजी नंबर के कुछ भाग पर विपक्षी पांचू यादव द्वारा 5 फीट की दीवार खड़ी कर टीनसेड तथा सामने खाली पड़ी जमीन पर नाद खूंटा रखकर कब्जा किया हुआ है जिसके संबंध में आवेदक द्वारा पूर्व में उप जिलाधिकारी सदर के न्यायालय में धारा 24 उत्तर प्रदेश राजस्व संहिता के अंतर्गत वाद दाखिल किया है जो विचारण मे है मौके पर दोनों पक्षों को बताया गया कि वाद निस्तारण के बाद ही कोई कार्यवाही की जाएगी
शान्ति व्यवस्था के दृष्टिगत दिनांक16.01.2023 को उभयपक्षों के विरूद्व अन्तर्गत धारा107116 सीआरपीसी की कार्यवाही स्थानीय पुलिस द्वारा की गयी है मौके पर शान्ति व्यवस्था कायम है फिर भी प्रकरण पर सतर्क दृष्टि रखने हेतु प्रभारी निरीक्षक कोतवाली कटरा को निर्देशित किया गया है आवेदक द्वारा अपने प्रार्थना पत्र मे अंकित अन्य आरोपों के समर्थन मे अब तक की जॉच से कोई पुष्टिकारक साक्ष्य नही पाया गया जॉच आख्या सादर अवलोकनार्थ सेवा मे प्रेषित है श्रीमान् जी आख्या संलग्न है
