The matter concerns the arbitrary and inconsistent report submitted by the in-charge of the Chauri bazar police station and the concerned circle officer which is attached as the first page of the submitted documents to the grievance.

It is most unfortunate that not a single individual ram the opposition party was named in the report are the police which is mockery of the law of land and showing the cryptic dealings of the police in the matter and integrity of the police is under cloud.

How will a police personnel will go to heaven to summon Vakil Dhar Tiwari S/O Ram Chandra Tiwari

who is living in heaven after departing from this mortal world?

Subject-grabbing of the Abadi land by Tej Dhar Tiwari S/O Ram Chandra Tiwari the therefore action must be taken against him under the appropriate section of the Indian Penal Code.

The matter concerns the grabbing of Abadi land which has been partitioned among the 4brothers having equal shares About 45 years ago. The details of the shareholders are as follows.

1- Tej Dhar Tiwari S/O Ram Chandra Tiwari

2-Vidyadhar Tiwari S/O Ram Chandra Tiwari

3-Vakil Dhar Tiwari S/O Ram Chandra Tiwari

4-TahsilDhar Tiwari S/O Ram Chandra Tiwari

It is quite obvious that entire Abadi land belonging to my grandfather Mr Ram Chandra Tiwari divided among 4 sons equally as aforementioned.

Short submissions in the matter are as follows.

1-The father of the applicant Late Vakil Dhar Tiwari S/O Ram Chandra Tiwari has departed to the heavenly abode.

2-There are 4 sons of my father Vakil Dhar Tiwari S/O Ram Chandra Tiwari, one of them is living at home and rest of the 3 including the applicant living in Mumbai for earning livelihood.

3- Tej Dhar Tiwari S/O Ram Chandra Tiwari and Tahsil Dhar Tiwari S/O Ram Chandra Tiwari have made their houses in their share of lands.

4-VidyadharaTiwari S/O Ram Chandra Tiwari and Vakil Dhar Tiwari S/O Ram Chandra Tiwari could not complete their houses due to inevitable circumstances.

5- Tej Dhar Tiwari S/O Ram Chandra Tiwari is trespassing the land of my grandfather late Vakil Dhar Tiwari S/O Ram Chandra Tiwari by setting pegs to tie buffalo and feeding cattle.

The applicant is making inquiry to the investigation officer and circle officer concerned under Article 51 A of the constitution of India, where is the opposition party who were mentioned in the grievance as Tej Dhar Tiwari S/O Ram Chandra Tiwari and his sons. Vide attached report of the police.

Investigation officer and circle officer in the office of Superintendent of police Sant Ravidas Nagar Bhadohi may provide the following information to the information seeker point wise as follows.

1- Sir, the complaint of land grabbing by the applicant was made against Tej Dhar Tiwari son of Ramchandra Tiwari, in which his sons were also involved. Under which law was the investigating officer detaining the remaining three brothers and their sons under sections 151, 107 and 116 of the Criminal Procedure Code? Please provide the provisions of the law available in the country.

2- Sir, the applicant should be informed whether the complaint of the applicant was processed by the investigating officer after taking perusal of it if not done before submitting the report, then why, he should he provide the reason?

3- Sir, provide the name, designation and date of joining the district of the investigating officer to the information seeker.

4- Sir, explain whether the case of land grabbing is civil or a criminal case if someone is forcibly taking the possession obvious from the matter.

Please provide the 4 point information to the information seeker within stipulated time of 30 days as prescribed under subsection one of Section 7 of the right to Information Act 2005.
