An appeal under subsection one of section 19 of the right to Information Act 2005 against the central public information officer who provided incomplete and misleading information to the appellant.

The brief submissions of the appeal are as follows.

Sought information 1-The applicant had submitted the renewal application for the cash credit account before the branch manager quite obvious from the following document.

Central Public Information may provide the noting made by the concerned accountable staff on the renewal application.

Reply of CPIO-There is no noting on the file.

Which means renewal application was not entertained by the competent authorities. The applicant is satisfied with the reply made by the CPIO in this point.

Sought information 2-Provide the name and designation of the staff of the bank who are processing the renewal application of the cash credit account of the proprietor of the Om Gas agency regarding renewal of CC account no.0069608700013264.

Reply of CPIO-according to central public information officer, this information is exempted from disclosure under subsection 1 (J) of Section 8 of the right to Information Act 2005.

Subsection 1 (J) of Section 8 of the right to Information Act 2005 states as-information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information:

Provided that the information which cannot be denied to the Parliament, or a State Legislature shall not be denied to any person.

Here renewal application has been made by the information seeker itself so this information does not concern with any other person as far as name and designation of the staff are concerned which must be disclosed to promote transparency and accountability in the working of the public authority which is the object of Right to Information Act 2005.

Here public authority is not disclosing the information because they are frightened that if the information will be disclosed in public domain their corruption will be exposed which is the root cause they are avoiding disclosure of information. Please direct them to disclose the information in the interest of justice.

Sought information 3-If the branch manager did not take any action in the matter, then branch manager must tell the reason of its decision as required under section 1d of the section 4 of the right to Information act 2005.

CPIO must provide the detail of the action taken by the branch manager concerned. Here CPIO must confine to the renewal application only. CPIO must provide the role of the branch manager in the renewal of the application.

Sought information 4-It is quite obvious that applicant which means proprietor of the Om Gas agency visited repeatedly at the branch office and requested the branch manager to take the appropriate action in the matter in the direction of the renewal of the CC account of the agency.

Central Public Information Officer may provide the minutes of the proceedings done by the branch manager in the matter.

CPIO must provide the action taken by the branch manager regarding renewal application cash credit account of om gas agency even orally. The appellant advises central public information officer to see the Hindi version of minutes are proceedings. Since the central public information officer is claiming that under point 4, the information seeker is not seeking any information while appellant is seeking from the central public information officer as- Central Public Information Officer may provide the minutes of the proceedings done by the branch manager in the matter.
