The applicant is Proprietor Om Gas Agency (Rajesh Sharma), Bulandshahr is being exploited by the branch manager Punjab National Bank by making the mockery of the law of land ipso facto.
PNB is one of the 14 banks nationalised in 1969. Government of India continues to hold majority shares of the Bank. So PNB can be called a Government Bank.
The matter concerns with the exploitation of a woman is a widow of an army personnel by the branch manager of the Punjab National Bank.
Reserve Bank of India is a regulatory body of entire financial institutions working on the soil of this country.
Everyone knows that bribery and the exploitation of the working woman has been curse to our society especially public system which is the root cause the applicant is facing too much hardships in carrying out the business of the husband who departed to the heavenly abode in a road accident.

1-The applicant had submitted the renewal application for the cash credit account before the branch manager quite obvious from the following document.
Central Public Information may provide the noting made by the concerned accountable staff on the renewal application.
2-Provide the name and designation of the staff of the bank who are processing the renewal application of the cash credit account of the proprietor of the Om Gas agency regarding renewal of CC account no.0069608700013264.
3-If the branch manager did not take any action in the matter then branch manager must tell the reason of its decision as required under section 1d of the section 4 of the right to Information act 2005.
4-it is quite obvious that applicant which means proprietor of the Om Gas agency visited repeatedly at the branch office and requested the branch manager to take the appropriate action in the matter in the direction of the renewal of the CC account of the agenc

Act of chief manager is ultra vires to provisions SARFAESI Ac The applicant is not a wilful defaulter as defined under the SARFAESI act 2002 so her loan cannot be declared as non-performing assets by the chief manager not a single terms and conditions defined as follows is applicable on the applicant. Notice issued by the chief manager Punjab National Bank to auction the home of the applicant was an arbitrary decision harsh and draconian in the nature and such steps by him are unconstitutional violating the human rights of the vulnerable lady who is the wife of late army personnel. Entire nation respects the army of the country including our great Prime Minister. How can chief manager of the Punjab National Bank deprive the widow of an army personnel through his arbitrary and cryptic dealings? Please order an enquiry into the matter so that justice may be available to the applicant and the applicant may not be pressed to live on road by allowing arbitrary working of chief manager.

1-Can you auction the house of the applicant if there may be a balance of Rs.50 in C.C. Account of the applicant by misusing provisions of SARFAESI Act 2002? 2-After O.T.S., you did the renewal temporarily and the applicant submitted a renewal application. According to rule, you had to pursue the procedure of law to make the loan N.P.A. but you have not followed but making mockery of provisions of SARFAESI Act 2002? 3 and 4-As one time settlement was fulfilled by the applicant. 5-In 2017, bank granted C.C. Loan on the same stock and in renewal application they are questioning stock. Whether the integrity of Bank staff is not under cloud? Whether it is not corruption? 6-The stock statement submitted by the applicant is of Rs.7025416 obvious from the report of the chartered accountant dated 20 Oct 2022. Vide page 1 of the attached PDF document to the grievance supported by Stock verification report of staff of Bharat Petroleum Corporation Limited as page 2. No doubt the applicant is a credible customer of the bank and no loss to the bank because of the applicant but the bank staff because of corruption harassing a vulnerable lady. Sir,
It is to be informed with respect that Om Gas Agency was approved by Bharat Petroleum Corporation (Ltd.) in the year 1999 in the name of my (disabled military serviceman) Late Shri Vraj Nandan Sharma under the quota of disabled military serviceman. After his death, being his wife (widow), BPCL transferred the agency to me, which I am running.
I am running the business of Om Gas Agency satisfactorily from your bank for a long time. Keeping in view the satisfactory/smooth business of the agency, on my request you had sanctioned the CC of Rs.50 (fifty) lakhs. Whose operation was going on smoothly. Due to some unavoidable reasons the explosive license of the agency could not be renewed. Due to which BPCL stopped the supply.
Due to Corona (Covid-19) in the middle of two years, due to the advice of doctors / government, she could not go out due to old age. Due to which there was delay in renewal of explosive license. I kept contacting the officials of Explosives Department through telephone/mobile. Explosive office renovation done on 20/07/2021. Photocopy is attached for ready reference. After which BPCL was requested to start the supply. It became operational in November 2021 with continuous efforts. Gas supply started from 02-11-2021 (photocopy of invoice number 4631046833 dated 02-11-2022 is attached)
During this period from 8/2019 to October 2021, due to the closure of the business and no solid source of income, I could not make full payment of the interest of CC. It is notable that I have deposited an amount of Rs 13,50,201 in the CC account in the last 6 months on time-2. Willing to pay the balance interest amount. I will continue to pay interest continuously in future and will also try to deposit small amount in principal from time to time.
Therefore, it is a humble request to you that due to being a widow (wife) of a disabled military servant and having no other means of livelihood.

The applicant is an army personnel widow Whose husband expired in the year 2013 having the responsibility of 2 daughters and one son and now near about 56 years old. If expelled from house, we will come on the road.
Prayer-Illegal auction notice of house of widow dated 19 July 2023 and date fixed for auction on 22 Aug 2023 by branch manager moreover without any notice on 03 Aug 2023. Please restrain him and proper enquiry may be ordered in the matter against B.M.
Short submissions of the matter is as follows.
1-The applicant/widow army personnel has requested to the branch manager concerned who is posted in the concerned branch for many years for the renewal of the cash credit account CC account - 0069008700013264. 2- It must be noted that the applicant from 27-10-2021 to 02-08-2023, has Deposited 3067312.83 Lack In PNB CC account - 0069008700013264. Which shows the positive approach of the applicant to pay the debt of the bank. Vide page 2 and 3 of the attached PDF document.
3-The applicant wants to draw the kind attention of the senior rank officers to the auction notice published in the e- news of the Amar Ujala daily which tells the time of auction is on 03 August 2023 between 11 o clock in the morning to 04 o clock in the evening. Vide fourth page of attached PDF document. The applicant was not served any notice regarding it so it is arbitrary action on the part of the bank.
4- Right to reason is the indispensable part of the sound administrative system as quoted by the honourable apex court of India in its various judgements. Under Article 51 A of the constitution of India the applicant wants to know the action taken by the branch manager on the renewal application of CC account and if rejected then provide the reason of rejecting my application.
Branch manager is hatching conspiracy to expel the widow of the army personnel from her own house.

If the borrower becomes a wilful defaulter as defined by the RBI Master Circular on wilful defaulters vide RBI circular (RBI/2014-15/73 DBR.No.CID.BC.57/20.16.003/2014-15 dated July 1, 2015) SARFAESI Act proceeding can be issued even without notice to the borrower. Who is a wilful defaulter? Deliberate non-payment of the dues despite adequate cash flow and good net worth Siphoning off of funds to the detriment of the defaulting unit Assets financed either not been purchased or been sold and proceeds have been misutilised Misrepresentation / falsification of records Disposal / removal of securities without bank's knowledge Fraudulent transactions by the borrower. Banks/ FIs throwing overboard these norms, classify all the MSME NPAs as wilful defaulters to apply the SARFAESI lever. As per the Act, valuation of the asset has to be done and notify that valuation to the borrower before issuing public notice for auction of property.

5-Honorable Sir the action of the bank against the widow of the army personnel is the sheer violation of the human rights of the applicant which must be curbed by the government. This draconian step of the bank must be restrained by the accountable staff of the government restraining branch manager of the bank.
Branch manager is hatching conspiracy to expel the window of the army personnel from her own house in corrupt way.
