In the earlier grievance, S.H.O. Jigna, District-Mirzapur did not take the perusal of the attached order of the court in PDF format but now the applicant expects from him to take perusal of the order of the Honourable court and acts accordingly in compliance with the court order.
It is most regretful that the concerned sub inspector belonging to the police station Jigna district Mirzapur is telling a lie in the report submitted on the Jansunwai portal of the Government of Uttar Pradesh. It would be expedient to reveal the truth that the elder brother of the applicant informed the police station Jigna about the direction of the court and made an
attempt to provide the copy of the order to the concerned staff of the police station Jigna. The concerned sub inspector did not take the copy of the order from the elder brother of the applicant but made an attempt to talk nonsense which was unproductive in the matter and against the morals of a police personnel. This event took place on the same date as the order received by the elder brother of the applicant from the court.
According to the law of the land every activity of the police is noted on the government diary available at the police station as a record. Whether the concerned sub inspector will make available the copy of the page of the government diary in which it has been mentioned that order of the court has not been made available to the police on the part of the applicant. It is obligatory duty of the accountable public functionaries in the department of police to ensure transparency and accountability in the working of the Jigna police. According to the concerned sub inspector in such matters there is no need of order and no need to take shelter in the court. The applicant had to visit the police station only and gratify them and fulfil their demands. Moreover if the station house officer police station Jigana is really interested in ensuring the compliance of the court order then the order was attached to the grievance. Why did he not take action to ensure the compliance of the court order?

सेवा में थाना अध्यक्ष पुलिस स्टेशन- जिगना, जनपद- मिर्जापुर महोदय प्रार्थी आपसे मिल चुका है और मिलकर स्थगन आदेश की प्रति उपलब्ध कराई गई किंतु अभी तक विपक्षी द्वारा कार्य रोकने की दिशा में कोई प्रयास नहीं किया गया अर्थात माननीय न्यायालय के आदेश की अवमानना हो रही है कृपया मामले में पारदर्शिता और जवाबदेही सुनिश्चित करें जिसके लिए प्रार्थी सदैव आपका आभारी रहेगा माननीय न्यायालय द्वारा पारित आदेश निम्न है और उस आदेश की प्रति इस शिकायत के साथ संलग्न है कृपया शिकायत की अनदेखा न करें अन्यथा माननीय न्यायालय के आदेश की अवहेलना होगी महोदय उसके लिए आप जिम्मेदार होंगे क्योंकि आदेश सुनिश्चित करना आपका दायित्व है स्थित बहुत ही भयावह है न्यायालय के आदेश के बावजूद निर्माण हो रहा है जो किसी भी तरह से नीतिगत नहीं है कृपया बौद्धिकता और नैतिकता को साथ में बढ़ावा दें आदेश के बावजूद निर्माण अराजकता का द्योतक है कृपया अराजकता को नियंत्रित करें जिसके लिए प्रार्थी श्रीमान जी का आभारी रहेगा

दिनांक: 22.05.2023 पत्रावली पेश हुयी । कार्यालय की आख्या के अनुसार कैबिएट दाखिल नहीं है।
सत्र वादीगण मुकदमा के विद्वान अधिवक्ता उपस्थित आये । प्रार्थना पत्र 6ग मय शपथपत्र 7ग वास्ते अस्थाई निषेधाज्ञा अन्तर्गत आदेश 39 नियम 1 सी०पी०सी० पर एक पक्षीय रूप से सुना एवं पत्रावली का अवलोकन किया।
पत्रावली पर सूची 10ग से उद्धरण खतौनी फसली वर्ष 1428-1433 कागज सं० ( उत्तर 10 / 2 एवं उद्धरण खसरा फसली वर्ष 1429 कागज सं0 10ग / 3 का अवलोकन किया गया। उक्त प्रपत्रों के अवलोकन से प्रथम दृष्टया वादीगण के पक्ष में अस्थायी निषेधाज्ञा जारी किये जाने का पर्याप्त आधार है। यदि ऐसा नहीं किया जाता है तो वादीगण का दावा लाने का उद्देश्य विफल होने की प्रबल सम्भावना है।
अतः प्रतिवादीगण को दिनांक 15.07.2023 नियत करते हुए प्रार्थना पत्र 6ग के आपत्ति निस्तारण हेतु नोटिस निर्गत हो तब तक के लिए प्रतिवादी सं0 1 को मना किया जाता है कि वह आराजी सं0 105 रकबा 0.04200, जो कि दृष्टिमानचित्र में अक्षर अ, ब, स द से दर्शित है, स्थित ग्राम विहसडा खुर्द, तप्पा 96 परगना कंतित, तहसील सदर, जिला मीरजापुर राजस्व अभिलेखों में जहाँ स्थित हो, के बाबत वादीगण के कब्जा दखल में नियत तिथि तक किसी प्रकार का कोई प्रस्तुत मामले में किसी अन्य न्यायालय का आदेश होने की सूरत में यह आदेश स्वतः ही निष्प्रभावी होगा। वादीगण आदेश 39 नियम 3 जीदी० का अनुपालन अविलम्ब करें।
