The matter concerns the working of the circle officer of police City Mirzapur Mr. Parmanand Kushwaha as Minu Patel, Wife of Ram Kripal is not providing wages of the applicant and his two companions amounts Rs.40000.
To register a case against Menu Patel under prevention of atrocity on S.C. and S.T. Act 1995 as amended in 2011 who is not only harassing the applicants through police but also not providing wages Rs.40000 caused the entire family of the applicant on the verge of hunger. Why has our case not been registered by the concerned police? Whether justice is available to the oppressed section in the government of Uttar Pradesh.

महोदय जितना भुगतान होता था प्रार्थी गण की ओर से प्रितेश कुमार मीनू पटेल के पति रामकृपाल की डायरी पर हस्ताक्षर करते थे और रामकृपाल जी प्रितेश कुमार की डायरी पर हस्ताक्षर करते थे इसलिए हर बात आईने की तरह साफ है
महोदय इस समय मीनू पटेल द्वारा पति रामकृपाल की डायरी नहीं दिखाई जा रही है और पुलिस देखना भी नहीं चाहती है क्योकि पुलिस द्वारा पूर्व धारणा बना कर पुरनियोजित ढंग से प्रार्थी गण पर दबाव बनाया जा रहा है

When the applicants demand the wages she is reaping the benefits of being women threatening to implicate the applicants under the charges of molestation by influencing the police. Whether justice is not available to the oppressed section in the state of Uttar Pradesh?
The applicant has sent the representation to Assistant Labour Commissioner Mirzapur by registered which awaits swift action after proper enquiry cum investigation in the matter.
The matter concerns the exploitation of the members of the oppressed section. Police may register a First Information Report in the matter against opposition for harassing the applicants belonging to the oppressed section.

Subject-Chowki In-charge and subordinates are creating undue pressure on the applicants to leave the claim of Rs.40000 wages otherwise they will fabricate us under false charges.
Most Honourable Sir,
We applicants belong to the oppressed section and earn livelihood by working as labourers. If our wages are snatched by the help of the police then we will die of hunger.
Think about the credibility of the police not providing any reprieve to the labourers belonging to the oppressed section.
Credibility of the reports submitted by the police in the matter can be easily guessed from the facts that not a single statement mentioned in the report of the chauki incharge Mandi samiti is true.
It is quite obvious that chauki incharge had a conversation with the applicant on his mobile number and talked about the compromise in the matter. When the applicant had asked that sir you may be instrumental in providing the wages of the poor labourers then he denied and said that it is not possible.
Why is the police supporting the stand of the woman who wants to bungle the rupees 40000 wages of the poor labourers?
Now the applicants confirm that there is no transparency and accountability in the dealings of the police which is the root cause the police is submitting arbitrary and inconsistent reports.

Whether it is not obligatory duty of labour enforcement officer to apply own mind to find the truth. It is quite obvious that he did not apply his discretion in the matter. Also he did not check the documents arbitrarily.

The matter concerns mismanagement in the office of assistant labour commissioner Mirzapur where labour enforcement officers only suggest the names of advocates to file petition in the court of assistant labour commissioner. They do not resolve any case of labourers and finally these labourers bow their heads before cumbersome proceedings. Why are they not playing their own role as subordinates of assistant labour commissioners? Justice is not available to labourers because of cryptic dealings of the labour enforcement officers to poor labourers. The applicant has an objection to the report submitted by the labour enforcement officer because the evidence submitted by the applicant having the supportive documents while the opposition parties submitted the evidence is a concocted report. There must be transparency and accountability in the working of the office of the assistant labour commissioner district Mirzapur. It is a well known fact that the applicants are poor labourers and they are not in position to hire a council for itself and he must be instrumental in providing the labour charge by acting against the employer. Here this question arises: what are the role of labour enforcement officers only to suggest parties for filing the suit in the court of assistant labour commissioner?. I think that the role of assistant labour commissioner will commence after the decision of the labour enforcement officer by adopting a logistic approach in examining the papers submitted by the parties.

महोदय अभी तक जो कुछ भी भुगतान हुआ है वह प्रार्थी के डायरी पर दर्ज है और उस डायरी पर नियोक्ता मीनू पटेल के पति रामकृपाल का हस्ताक्षर है और उनके डायरी पर प्रार्थी का हस्ताक्षर है अर्थात मामला दर्पण की तरह साफ है जो कुछ भी पेमेंट हुआ है नियोक्ता के तरफ से वह स्पष्ट है इस शिकायत के साथ प्रथम पेज के रूप में दिनांक 27 मार्च 2023 कौशलेंद्र कुमार सिंह श्रम प्रवर्तन अधिकारी मिर्जापुर का रिपोर्ट है द्वितीय पेज के रूप में श्रम एवं रोजगार मंत्रालय द्वारा जारी प्रार्थी का श्रम कार्ड है जिसका क्रमांक 711321062172 है और तृतीय पेज के रूप में उत्तर प्रदेश भवन एवं अन्य निर्माण कर्मकार कल्याण बोर्ड निर्माण श्रमिकों का पंजीयन प्रार्थना पत्र जिसका सत्यापन निमेंश कुमार पांडे द्वारा किया गया है चतुर्थ पेज के रूप में प्रार्थी द्वारा श्रम प्रवर्तन अधिकारी के समक्ष प्रस्तुत पूरा विवरण है जो निर्माण कार्य में प्रार्थी गणों की ओर से मजदूरी को दर्शाता है पांचवें पेज के रूप में प्रार्थी का आधार कार्ड लगा हुआ है श्रीमान जी हम लोगों ने तो आपको समस्त विवरण उपलब्ध कराए थे किंतु आप द्वारा विपक्षी मीनू पटेल को अभी तक नहीं बुलाया गया और आप कह रहे हैं कि हम लोग समुचित दस्तावेज आपको नहीं उपलब्ध कराए हैं इस समय समस्त दस्तावेज आपकी सेवा में संलग्नको सहित संलग्न है उनका अवलोकन करें और जब भी आप आदेश पारित करें हम लोग आपके कार्यालय में उपस्थित होंगे कृपया मामले का तार्किक निस्तारण करें और प्रार्थी गण को न्याय दिलाएं प्रार्थी गण दलित समाज से आते हैं उनके अधिकारों की रक्षा करें मजदूरी ना मारा जाए यहां पर विपक्षी प्रार्थी गण की मजदूरी नहीं देने के लिए प्रशासन स्तर पर काफी दबाव बना रहा है जो किसी तरह से उचित नहीं है मामले की जांच पारदर्शिता के साथ जवाबदेही तय करते हुए किया जाए
महोदय कौशलेंद्र कुमार सिंह श्रम प्रवर्तन अधिकारी मिर्जापुर अपने रिपोर्ट 27 मार्च 2023 में कहते हैं कि शिकायतकर्ता प्रितेश कुमार निवासी डऺगहर मिर्जापुर और सेवा आयोजक मीनू पटेल पत्नी राम कृपाल बथुआ मिर्जापुर के दोनों के बयानों में विरोधाभास है सेवायोजक कहता है कि उसने मजदूरी दे दी है और मजदूर कहते हैं कि उनको मजदूरी नहीं मिली है दोनों पक्षों को कार्यालय में पूर्ण विवरण के साथ उपस्थित होने को कहा गया है किंतु अभी तक किसी पक्ष द्वारा कोई विवरण प्रस्तुत नहीं किया गया है जिससे कि उनके शिकायत का समाधान किया जा सके श्रीमान जी को प्रार्थी यह सूचित करता है कि अभी तक श्रम प्रवर्तन अधिकारी द्वारा कोई भी नोटिस या सम्मन मजदूर पक्ष को कार्यालय सहायक श्रम आयुक्त लेबर कॉलोनी जंगी रोड मिर्जापुर द्वारा तामिल नहीं कराया गया है और यदि ऐसा कोई सम्मन प्रार्थी के संज्ञान में आता है तो प्रार्थी मजदूर गण उस आदेश का

There is no certain criteria to decide the claim of the labourers which is quite obvious from the fact that each matter is left on the aggrieved to file case before the assistant labour commissioner quite obvious from the report. There is no transparency and accountability in the dealings of the concerned public authority.
