Grievance Description
The matter concerns the working of the Superintendent of police Sant Ravidas Nagar Bhadohi where grabbing of land has been a practice of unlawful elements because of lackadaisical approach of the police in dealing with the matter. No property is safe if the guardian is away from it. It seems that rule of law has been replaced by anarchy. To Station house officer police station Chauri Bazar

Subject-grabbingof the Abadi land by Tej Dhar Tiwari S/ORam Chandra Tiwari the therefore action must be taken against him under theappropriate section of the Indian Penal Code.
Thematter concerns the grabbing of Abadi land which has been partitioned among the 4brothers having equal shares About 45 years ago. Thedetails of the shareholders are as follows.
1- TejDhar Tiwari S/O Ram Chandra Tiwari
2-Vidyadhara Tiwari S/O Ram Chandra Tiwari
3-VakilDhar Tiwari S/O Ram Chandra Tiwari
4-TahsilDhar Tiwari S/O Ram Chandra Tiwari
It isquite obvious that entire Abadi land belonging to my grandfather Mr Ram ChandraTiwari divided among 4 sons equally as aforementioned.
Shortsubmissions in the matter is as follows.
1-Thefather of the applicant Vakil Dhar Tiwari S/O Ram Chandra Tiwari has departedto the heavenly abode.
2-Thereare 4 sons of my father Vakil Dhar Tiwari S/O Ram Chandra Tiwari, one of themis living at home and rest of the 3 including the applicant living in Mumbaifor earning livelihood.
3- TejDhar Tiwari S/O Ram Chandra Tiwari and Tahsil Dhar Tiwari S/O Ram ChandraTiwari have made their houses in their share of lands.
4-VidyadharaTiwari S/O Ram Chandra Tiwari and Vakil Dhar Tiwari S/O Ram Chandra Tiwaricould not complete their houses due to inevitable circumstances.
5- TejDhar Tiwari S/O Ram Chandra Tiwari is trespassing the land of my grandfatherlate Vakil Dhar Tiwari S/O Ram Chandra Tiwari by setting pegs to tie buffaloand feeding cattle.
6-Mybrother Vinod Kumar Tiwari S/O Late Vakil Dhar Tiwari submitted repeatedrepresentations before the concerned police but they did not take any interestin the matter and the opposition party is working like anti-social elements andnot abiding the rule of law.
Section441 (Criminal Trespass): When someone unlawfully enters a property, or lawfullyenters a property but unlawfully remains there (such as a tenant afterexpiration of tenancy) with the intent to commit an offence, or to intimidate,insult or annoy the person in possession of such property, it amounts tocriminal trespass. Section 425 (Mischief): When someone intentionally orknowingly causes destruction of a property or any change in a property thatdiminishes its value or utility, they are said to commit “mischief”. Section420 (Cheating): This provision is applied when someone cheats and deceives youinto delivering any property to someone else. #Section 442 (House Trespass):This is a form of “criminal trespass” wherein the trespasser unlawfully entersa human dwelling, or any building used as a place of worship or as place forthe custody of property. Section 503 (Criminal Intimidation): Any threat ofinjury to person, reputation or property with the intent to cause them to dosomething which they are not legally bound to do is a form of “criminalintimidation”.
This is a humble request of your applicant toyou Hon'ble Sir that It can never be justified to overlook the rights of thecitizenry by delivering services in an arbitrary manner by floating all set upnorms. This is sheer mismanagement which is encouraging wrongdoers to reap thebenefit of loopholes in the system and depriving poor citizens of the right tojustice. Therefore it is need of the hour to take concrete steps in order tocurb grown anarchy in the system. For this, your applicant shall ever pray to you,Hon'ble Sir.
