According to subsection 1 d of section 8 of R.T.I. Act 2005, ) information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information;
Sought information by the appellant are as follows.
1-Provide the posting details of sub inspector Anil Kumar Rana including date of joining in the district-Budaun as well as first posting details when he joined the service of the police with last posting details.
2-Provide the posting details of inspector of police station-Kotwali with name and designation including date of joining in the district-Budaun as well as first posting details when he joined the service of the police with last posting details.
3-Right to reason is an indispensable part of the sound administrative system therefore PIO may provide the reason for unsigned general diary details attached as page 2 of PDF document to this RTI application.
4-Please provide the name and designation of the executive magistrate before whom this unsigned general diary details was submitted by sub inspector Anil Kumar Rana and the executive magistrate accepted it.
5-Land under dispute is the registered land in the name of my husband Vimal Kumar Rastogi but police said in reports that it is a matter of partition. Please provide the reason for it.
6-In sub judice matters in which adjudication is pending before a competent court, how can police allow grabbing of land by offenders in the form of new construction ipso facto? Please provide the reason for not registering the F.I.R. after numerous representations of the husband of the information seeker.
Ground of denial-Information is commercial confidence, trade secrets or intellectual property and disclosure of it harms third party.
Here it is noticeable that sought information concerns working of the police which disclosure will increase transparency and accountability in the working of the police. Right to information Act 2005 was introduced by government to promote transparency and accountability in the working of the public authority.
Whether police perform commercial activity or police performs trade or acts of police are intellectual property. At least PIO must take suggestion from S.S.P. before categorising working of police under commercial confidence, trade secrets or intellectual property.
FAA may direct PIO to provide 6-points information as aforementioned as concerned police are only concealing their corruption by withholding sought information through PIO.
