Prayer- Public information officer did not entertain RTI application within time 30 days as prescribed under subsection 1 of section 7 of the right to information act 2005 and still they have not provided any information.
Short submissions of the appellant are as follows.
1- The matter concerns Executive engineer electricity distribution division 2nd Mr Rajesh Kumar District Mirzapur. The public information officer has been habitual not to provide any information to the information seekers ipso facto.
2- From the status of the RTI application, it is quite obvious that the appellant submitted RTI application on 5th December 2023 which was forwarded on the same date to the executive engineer electricity distribution division 2nd Mr Rajesh Kumar, but he did not entertain the RTI application still. Which is a mockery of the provisions of the right to Information Act 2005.
3-It is quite obvious that public information officer did not entertain RTI application after two months which is violation of the subsection 1 of section 7 of the right to information at 2005. It is a mistake of the law which is not excusable under the law of land.
4- Mrs. Prabhavati Devi wife of Mr. Ram Avtar Has two sons and two daughters-in-law whose description is as follows.
1-Sunita, wife of Mr. Mangala Prasad and 2-Preeti W/O Ashok Prasad
In the same premises you have provided the electricity connection to the Preeti W/O Ashok Prasad who is the sister-in-law of the aggrieved applicant Sunita, wife of Mr. Mangala Prasad. Why is the following reason not applicable to Preeti W/O Ashok Prasad? Right to reason is the indispensable part of a sound administrative system so this reason must be provided to the applicant as required under the law. Under subsection 1 d of the section 4 of the right to information act 2005 it has been categorically stated that it shall be obligatory duty of each public authority to provide the reasons of its decision to the parties concerned. Do not conceal corruption.
5- It is submitted before the Honourable Sir the matter concerns the deep-rooted corruption in the working of the executive engineer electricity distribution division 2nd Mr Rajesh Kumar which is the Root-Cause, he is running away from providing information to the appellant.
6- There are two types of evidence of corruption. 1- Direct corruption means corruption having direct evidence, 2- Indirect corruption which are proved by Circumstantial evidence. In this matter circumstantial evidence prove the corruption in the working of the public authority resulting in withholding information by the public information officer.
7- The appellant sought following information from the public information officer.
1- Public information officer must provide the reason of providing the electricity connection to Preeti W/O Ashok Prasad if in the same premise, connection number 6418848000 is already approved in the name of Mrs. Prabhavati Devi wife of Mr. Ram Avtar resident of Tehsil Road, Mahuwaria, Mirzapur in 01 KW L.G.V. 2 mode. On which electricity bill of Rs. 125794.00 is outstanding.
2- Public information officer must provide the amount of bribe taken by the Department of electricity district-Mirzapur in providing illegal connection to Preeti W/O Ashok Prasad. I know that this amount is shared by all personnel who sign on the paper before passing an electricity connection.
3- Public information officer must provide the name and designation of the public staff who approved the electricity connection of Preeti W/O Ashok Prasad.
4- If this illegal work of providing connection to Preeti W/O Ashok Prasad was done due to poverty of the poor applicant and the charity to poor by the government of Yogi Adityanath, then why is the same ground was not followed in the case of Sunita wife of Mr. Mangala Prasad? Please provide the reason for it.
5- There is rampant corruption in the working of the public authority electricity distribution division second district Mirzapur, public information officer must provide the measures taken by the executive engineer electricity distribution division 2nd to curb it. Please also provide the details of the personnel who inspected the impugned site before providing electricity connection.
This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray for you, Hon’ble Sir.
