Grievance Description
The matter concerns the forgery and manipulation of revenue records which is amenable by concerned police by registering the first information report under appropriate sections of the Indian Penal Code. This is a humble request of the applicant to the Superintendent of police district Mirzapur to direct the station house officer, police station- Dramand Ganj, block-Halia, police circle Lalganj, district Mirzapur, Uttar Pradesh.
Land grabbing is a criminal offence while the land dispute is a civil matter. Here offenders hatched the criminal conspiracy by colluding with the staff of the tehsil Lalganj to eliminate the name of the father of the applicant from the revenue records.
It is quite obvious that offenders cheated the property of my father which was to automatically inherit to the applicant. There is no title dispute between the offenders and the applicant regarding the impugned land because the offenders did not get any order of the competent court before grabbing the land of my father, but they used a way of forgery and manipulation of the revenue record by eliminating the name of my father. The applicant is praying for justice before the accountable officers of the police. Such fraudulent elements must be demoralized by taking action against their cheating and dishonest acts.
It is quite obvious from the attached PDF reports to the grievance that police is illogically connecting it to the land dispute by overlooking the contents of the grievance. Whether the action can be taken by a magistrate or civil judge under sections 466 467 468 420 195 and 471 of the Indian Penal Code. It is obvious that police are running away from providing justice to vulnerable sections, especially women and girls. Whether the rights of women and girls in this largest democracy in the world are safe as claimed by our political masters during their election campaign.
Right to reason is an indispensable part of the sound administrative system so public information officers must provide the reason for not taking action against offenders under sections 466 467 468 420 195 and 471 of the Indian Penal Code. There is no title dispute between the applicant and opposite party, but a criminal conspiracy to deprive the applicant from the property of her father and police is escaping from the matter by taking recourse that the matter is civil which is illogical.
Police are making failed efforts to demoralize the applicant and her family members by registering the false first information report under preventive measures and submitting arbitrary and inconsistent and parrot reports in the matter which are frustrating and reflecting failure of the system in providing justice to the deprived in the society.
Police should not overlook the forgery of the public records which deprived the applicant from the property of her father on which her right is decided and proved from the birth. It is quite obvious that offenders grabbed the land of the father of the applicant through the forgery which is a criminal offence and this offence is amenable under the criminal procedure code and cases must be registered under the Indian Penal Code. Concerned police must be restrained from submitting worthless reports as done by them repeatedly.
For registering First Information Report against the conspirators who hatched conspiracy to exclude the name of my father from the revenue records, family register under the possession of secretary of the village panchayat and cheating the property by colluding with the Lekhpal, revenue inspector and tahsildar which was the share of my father.
Sub inspector Mr Arvind Kumar Saroj misused section 107 /116 of the criminal procedure code and overlooked guidelines of the High Court of judicature at Allahabad issued to prevent the misuse of section 151, 107 and 116 of the criminal procedure code and government of Uttar Pradesh through its department of home issued circular.
