Grievance Description

The matter concerns anarchy in the working of the police Mirzapur where there is no supremacy of the law. Here law is applied according to the convenience of police personnel. Sir, Government of Uttar Pradesh has nominated additional S.P. Mirzapur as public information officer and superintendent of police Mirzapur as the First Appellate Authoring to deal with the R.T.I. requests and subsequent appeals. It is quite obvious from the working of the superintendent of police Mirzapur, he never entertains the appeals submitted by the appellants. Here additional S.P. Mirzapur does not provide information to information seekers, but he directs the assistants to provide information to the information seekers which is illegal because information must be made available to information seekers under the signature of the PIO not APIO because section 20 is only applicable on PIO. Here PIO is also the nodal officer in the office of superintendent of police District-Mirzapur. In the name of nodal officer, how can PIO deal with the appeal of the appellants submitted under subsection 1 of section 19 of the Right to Information Act 2005? Whether superintendent of police District-Mirzapur can delegate his powers of First Appellate Authority to PIO cum nodal officer as done by him. Whether S.P. Mirzapur has not acted contrary to the government by delegating his powers of FAA to PIO cum nodal officer because powers FAA has been granted to him by the government of Uttar Pradesh by issuing proper notification. 
Assistant public information officer Mr Prabhat Ray, circle officer, city Mirzapur denied the sought Information by taking recourse of subsection 2 b of section 4 of UTTAR PRADESH RIGHT TO INFORMATION RULES, 2015. Here it is noticeable that the Information seeker has attached the same information sought from the Public Information Officer in the office of police commissioner Lucknow by anti-corruption crusader Yogi M. P. Singh and PIO have provided the same information through station officer Ashiana police station. Lucknow police did not deny the information, but Mirzapur police is running away from complying with the provisions of R.T.I. Act 2005 quite obvious from the attached document. Prayer or Relief Sought Here the application submitted under subsection 1 of section 6 of the Right to Information Act 2005 online on 30 May 2022 quite obvious from the attached status of the online application to this appeal. यहां सूचना का अधिकार अधिनियम 2005 की धारा 6 की उपधारा 1 के तहत 30 मई 2022 को ऑनलाइन जमा किया गया आवेदन इस अपील के साथ संलग्न ऑनलाइन आवेदन की स्थिति से काफी स्पष्ट है श्री मान जी क्षेत्राधिकारी नगर प्रभात राय का प्रार्थी को प्रेषित पत्र का दिनांक १२ मई २०२२ है और विनय कुमार राय चौकी प्रभारी मंडी समिति द्वारा क्षेत्राधिकारी नगर प्रभात राय को सम्बोधित पत्र का दिनाँक ०८ मई २०२२ है जिसको कोतवाल कटरा कोतवाली द्वारा १० मई २०२२ को अग्रसारित किया गया श्री मान जी क्या क्षेत्राधिकारी नगर प्रभात राय, कोतवाल कटरा कोतवाली और विनय कुमार राय चौकी प्रभारी मंडी समिति भविष्य द्रष्टा है जो इनको मालुम था की प्रार्थी ३० मई २०२२ को यही सूचना मागेगा श्री मान जी प्रार्थी को सूचना के नाम पर कुछ भी  दे देना किस परंपरा की शुरुआत है Where is the rule of law in this state of Uttar Pradesh? Information seeker has sought following information. The matter concerns the police station Kotwali Katra District-Mirzapur specifically. The Public Information Officer in the office of superintendent of police District-Mirzapur may provide the following feedback as sought by the information seeker. 1-Please provide the number of N.C.R. and number of F.I.R. registered in the current financial year police station Kotwali Katra District-Mirzapur and also the number of cases culminated into section 107/116/151 of Cr. P.C. which is a preventive measure. 2-Provide the fuel expenses in the form of diesel and petrol incurred in the police station Kotwali Katra District-Mirzapur by the police personnel in the financial year 2019-20 and 2020-21 only figures.

Here the matter concerns abuse of powers quite obvious from the arbitrariness in the working of the police. If superintendent of police Mirzapur is the first appellate authority, then he has to entertain the functions of the First Appellate Authority, but it is confirmed that not a single R.T.I. Appeal has been entertained by the superintendent of police Mirzapur. Additional S.P. Mirzapur sometimes provides information to information seekers, otherwise it is the job of circle officers and sub inspectors. Here the matter of concern is accountability, and it is dead sure that if something is found wrong, then both will not be accountable because the matter is dealt by the subordinates under their signature and action can be taken under section 20 of the R.T.I. Act 2005 against a public information officer who will tender an apology before the transparency ombudsman that he is innocent as the matter was dealt with by juniors. Our motive is salvation from anarchy for healthy society.

  2. श्रीमान जी यहां पर कानून का शासन कहां रहा जब जिलाधिकारी और पुलिस कप्तान कोई कार्य करते ही नहीं समस्त कार्य अधीनस्थों से कराते हैं ऑफिस में सिर्फ बैठते कोई भी कार्य नहीं करते मौखिक आदेश देते हैं लिखित आदेश से परहेज करते इसलिए कोई जवाबदेही है ही नहीं उन लोगों की जब वरिष्ठ अधिकारियों की कोई जवाबदेही नहीं होगी तो बनवाना पड़ेगा ना आज अगर लिखित जवाब दे ही रहे तो मनमाना कोई नहीं करेगा इस समय सिर्फ तानाशाही का राज जन सूचना अधिकार 2005 को एकदम प्रभाव शून्य कर दिया गया है क्योंकि भ्रष्टाचार चरम पर है और जन सूचना अधिकार कमजोर होता है और कोई भी भ्रष्टाचार को कम करना ही नहीं चाहता है
