How the continued construction by the Jal Nigam District Mirzapur, Uttar Pradesh is justified when the matter is under consideration of Honourable Salil Kumar Rai, J. of High court of Judicature at Allahabad quite obvious from the attached document to the grievance. Whether the Law Order situation in the state of Uttar Pradesh has reached Nadir and the government itself has no faith in the state's higher judiciary is quite obvious from the rapid increase in the pace of construction work by the Jal Nigam at the impugned site. An application under Article 51 A of the constitution of India on behalf of Sachchida Nand Shukla whose land has been grabbed as Jal Nigam by colluding with Tehsil Sadar grabbed land Araji number 326ख of Sachchida Nand Shukla in the name of Araji number 326क and now performing construction work. From the first page of the attached document to the grievance, it is quite obvious that aggrieved Sachchidanand Shukla took shelter in the High court of Judicature at Allahabad on 30 May 2022 subsequently High court registered writ number- 16620 of the year 2022 against the government of Uttar Pradesh and three others on 04/06/2022. I think that if the matter is sub judice before the High court of Judicature, then you must wait for the order of the court. Meanwhile, Sub-divisional magistrate Sadar may correct his error by passing appropriate order as required under the law. For more details, vide the attached document to the grievance.

Following the order passed by Honourable Salil Kumar Rai,J. on the request of the standing council. 
The Standing Counsel prays for and is granted a week's time to obtain instructions in the matter.
The Standing Counsel shall obtain comprehensive instructions including as to whether the plots were inspected by any Revenue Team and also regarding the map prepared by the concerned Revenue Officer during the measurement of Plot No. 326 Kha.

सच्चिदा नंद शुक्ल की जमीन को तहसील सदर की मिलीभगत से जल निगम  हड़प द्वारा हड़पा जा रहा है  सच्चिदा नंद शुक्ल की अराजी संख्या 326ख की जमीन अराजी नंबर 326क के नाम पर हड़पी जा रही  है और माननीय न्यायमूर्ति श्री सलिल कुमार राय के यहां सुनवाई त्वरित गति से होने के बावजूद योगी सरकार  निर्माण कार्य तेज कर दी  है जैसे न्यापालिका में सरकार का विश्वास ही नहीं है ।
संलग्न दस्तावेज से यह स्पष्ट है कि पीड़ित सच्चिदानंद शुक्ल ने 30 मई 2022 को इलाहाबाद उच्च न्यायालय में केस फाइल की थी, इसके उपरांत उच्च न्यायालय ने उत्तर प्रदेश सरकार और तीन अन्य के खिलाफ वर्ष 2022 की रिट संख्या- 16620 दर्ज की।
मुझे लगता है कि यदि मामला उच्च न्यायालय के न्यायिक में विचाराधीन है, तो आपको न्यायालय के आदेश की प्रतीक्षा करनी चाहिए।
इस बीच एसडीएम सदर कानून के तहत आवश्यक उचित आदेश पारित करके अपनी त्रुटि को सुधार सकते हैं। सच्चिदा नन्द शुक्ल की अराजी संख्या 326ख पर जल निगम द्वारा अराजी क्रमांक 326क के नाम से प्रारम्भ किये गये इस निर्माण कार्य को अविलम्ब रोक कर एसडीएम सदर को सच्चिदा नन्द शुक्ल की अराजी संख्या 326ख भूमि की सीमा निर्धारित करने का निर्देश दिया जाय।
सच्चिदा नन्द शुक्ल द्वारा उक्त प्रकरण 10/09/2021 को एसडीएम सदर जिला मिर्जापुर को भेजा गया ताकि भूमि की सीमा अराजी क्रमांक 326 ख तय की जा सके
लेकिन यह सबसे दुर्भाग्य की बात है कि आराजी क्रमांक 326 क भूमि सरकार की है, जिसे लेखपाल और राजस्व निरीक्षक द्वारा पहले से ही गुप्त और रहस्यमय तरीके से अवैध रूप से बेचा जा चुका है, फलस्वरूप उन्होंने पीड़ित सच्चिदा नंद शुक्ला की भूमि को हड़प कर  अपना बचाव कर रहे  है और इस मामले में एस.डी.एम. सदर की कार्यशैली संदिग्ध और अनियमितता पूर्ण  हैं, जो उनकी शिथिलता और गूढ़ कार्यशैली से स्पष्ट है। मामला उत्तर प्रदेश की धारा 24 के तहत प्रस्तुत अभ्यावेदन से संबंधित है। राजस्व संहिता, 2006, उ.प्र. सच्चिदा नंद शुक्ला द्वारा 2012 का अधिनियम संख्या 8 और सरकार में अराजकता के कारण एसडीएम सदर द्वारा कोई कार्रवाई नहीं की गई।
