Grievance Description

An application under Article 51 A of the constitution of India to make enquiry regarding the notification issued by the government of Uttar Pradesh to regularise the daily wage staff as the problem of unemployment is on its peak and youths are being exploited in our society even government departments are included in them. There are large scale violations of human rights which must be safeguarded by public spirited youth and human rights defenders and this is an effort in that direction. No pseudo honest people will be allowed to exploit the youths in this state.

The matter concerns the working of the Principal Kanhaiya Lal Basant Lal Postgraduate College district Mirzapur Uttar Pradesh regarding the following notification issued by the government of Uttar Pradesh on 12th September 2016.

IN exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of all existing rules and orders on the subject, the Governor is pleased to make the following rules:

THE UTTAR PRADESH REGULARISATION OF PERSONS WORKING ON DAILY WAGES OR ON WORK CHARGE OR ON CONTRACT IN GOVERNMENT DEPARTMENTS ON GROUP C AND GROUP D POSTS (OUTSIDE THE PURVIEW OF THE UTTAR PRADESH PUBLIC SERVICE COMMISSION) RULES, 2016

These rules may be called The Uttar Pradesh Regularisation of Persons Working On Daily Wages or On Work Charge or On Contract In Government Departments On Group C And Group D Posts (Outside The Purview Of The Uttar Pradesh Public Service Commission Rules, 2016. They shall come into force at once. For the more details, vide attached document to the RTI application.

The competent officer in the regional office Varanasi of higher education, government of Uttar Pradesh may provide the logistic viewpoint regarding following information to the applicant point wise as follows.

1- Please provide the list of the regularised personnel in Kanhaiya Lal Basant Lal Postgraduate College district Mirzapur Uttar Pradesh under the above notification issued by the government on 12th September 2016. It is most unfortunate that for 10 years no daily wage staff has been regularised by the government. Whether the government is not exploiting the intelligentsia class by providing them minimal wages by taking their services four times their wages? How can the exploitation of citizens by the government itself be justified even when our political masters are claiming to provide good governance?

2- Please provide a copy of the communications exchanged with the government by the Principal of Kanhaiya Lal Basant Lal Postgraduate College district Mirzapur Uttar Pradesh regarding the aforementioned notification issued by the government on 12th September 2016. Now elections are near to us and the electorate will decide the fate of the government. It means political parties if the notification has been issued then it must be followed and if it is not being followed which means this notification is only misleading the people in the state.

3- If not a single daily wage personnel was regularised under the aforementioned notification issued by the government then providing the reason for it as right to reason is an indispensable part of the sound administrative system. Right to reason of the citizens always preps the way of good governance so it must be strictly followed if our public staff, especially our political masters are interested in providing good governance at the ground level otherwise they may mislead the citizens through print and electronic media.

4- Please provide the precautionary measures taken by the Regional office Varanasi of higher education, government of Uttar Pradesh to maintain the transparency and accountability in the process of regularisation of the daily wage personnel under the aforementioned notification Under Article 51 A of the Constitution of India.

5- Please provide the total number of daily wage staff working in Kanhaiya Lal Basant Lal Postgraduate College district Mirzapur Uttar Pradesh and how many of them have been regularised under the notification which is attached to the grievance. .

Concerned competent officer in the office of regional office Varanasi of higher education, government of Uttar Pradesh must meditate on the aforementioned 5-points to provide logistic comments within stipulated days as prescribed under citizen charter of the government of Uttar Pradesh regarding the delivery of the public services.
