* Prayer or Relief Sought Land grabbing refers to any activity by which someone occupies or attempts to occupy any land over which they do not have any lawful entitlement. They may or may not use force, threats or intimidation with a view to illegally possess the land or create illegal tenancies or sell or construct unauthorized structures thereon. Whether land grabbers have lawful entitlement in the current matter? Police must provide the copy of title awarded by competent court or magistrate to them otherwise register case against them of land grabbing?
Tej Dhar Tiwari S/O Ram Chandra Tiwari is trespassing the land of my grandfather late Vakil Dhar Tiwari S/O Ram Chandra Tiwari by setting pegs to tie buffalo and feeding cattle.
The applicant is making inquiry to the investigation officer and circle officer concerned under Article 51 A of the constitution of India, where is the opposition party who were mentioned in the grievance as Tej Dhar Tiwari S/O Ram Chandra Tiwari and his sons.
First appellate authority must consider the submissions of the appellant as follows.
1-Under this point-public information officer provided the definition of the aforementioned sections of the criminal procedure code while he had to provide the information as-Under which law was the investigating officer detaining the remaining three brothers and their sons under sections 151, 107 and 116 of the Criminal Procedure Code? Please provide the provisions of the law available in the country. Here the appellant has sought the provisions of law not definition. It is quite obvious that land grabbers have the support of Police which is the root cause police is shielding them by not mentioning them as opposition party. Here prime accused of land grabbing is Tej Dhar Tiwari son of Ramchandra Tiwari supported by his sons.
2- Under this point-public information officer provided as if disputes brought up before the police then appropriate action is taken.
Appellant has sought a specific information concerning the working of the investigation officer who did not take perusal the contents of the grievance and submits the arbitrary and inconsistent reports on the Jansunwai portal. Under this point-public information officer
3- Under this point-public information officer has provided date of joining Chauri police station but he had to provide date of joining the district S.R.N. Bhadohi.
4-Here land grabbed forcibly without getting appropriate order from competent court or magistrate so it is a criminal offence so will be dealt under sections of Cr.P.C. and I.P.C. Where law of land is taken under teeth is a criminal offence cannot be overlooked falsely taking recourse of civil matter to support cryptically land gabbers.
Government of India introduced Right to Information Act 2005 to promote transparency and accountability in the working of the public authorities so that rampant corruption in the working of public authorities may be curbed but because of corruption it has not achieved its goal even partly.
