* Prayer or Relief Sought Registration Number SPMZR/R/2022/60019 Name Yogi M P Singh Date of Filing 11-05-2022, For more information, vide attached documents. It is 21 July 2022 today and appellant received the communication dated 19 July 2022 of denial of information sent by assistant public information officer / circle officer city Mr. Prabhat Ray attached to documents. Aforementioned APIO denied the sought information by taking the recourse of subsection 1 of section 11 of the Right to Information Act 2005 which is categorically stated as follows. Where a Central Public Information Officer or a State Public Information Officer, as the case may be, intends to disclose any information or record, or part thereof on a request made under this Act, which relates to or has been supplied by a third party and has been treated as confidential by that third party, the Central Public Information Officer or State Public Information Officer, as the case may be, shall, within five days from the receipt of the request, give a written notice to such third party of the request and of the fact that the Central Public Information Officer or State Public Information Officer, as the case may be, intends to disclose the information or record, or part thereof, and invite the third party to make a submission in writing or orally, regarding whether the information should be disclosed, and such submission of the third party shall be kept in view while taking a decision about disclosure of information: Provided that except in the case of trade or commercial secrets protected by law, disclosure may be allowed if the public interest in disclosure outweighs in importance any possible harm or injury to the interests of such third party. Here the matter is tetra polar. 1-Uttar Pradesh Human Rights Commission Lucknow. 2-Police 3-Complainant and 4-Victim Here complainant has sought information to be instrumental in providing justice to victim. Moreover, complainant has instituted the case before Uttar Pradesh Human Rights Commission Lucknow.against the police. It is legal right of the complainant and victim both to know the outcome of complaint in reasoned way. Since the police has abused its post and position therefore it is concealing the report from complainant and victim by falsely taking recourse of third party information. It is obligatory duty of police under principal of natural law to provide copy of submissions made before Uttar Pradesh Human Rights Commission Lucknow to complainant so that subsequent proceedings in the matter be made by the complainant.

  2. Think about the gravity of situation that the first appellate authority is the superintendent of police district Mirzapur but he did not entertain this appeal submitted by the appellant which is a mockery of The Right to Information act 2005.
