An appeal under subsection 1 of section 19 of the Right to Information Act 2005 against the denial of information by the CPIO sought under eight points by the information seeker. 
With due respect, the applicant invites the kind attention of the Honourable Sir to the following submissions as follows.
1-I pray before the Honourable Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;
(i) to safeguard public property and to abjure violence;

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.
2-It is submitted before the Honourable Sir that following information sought by the information seeker.

It is quite obvious that the concerned central public information officer and First appellate authority upheld denial of information from point 1 to 3 collectively denied information because of corrupt dealings in the working of bankers which is causing a manifold increase in N.P.A. i.e. Non Performing Assets. Section 58 to section 104 of Transfer of Property Act, 1882 deals with the mortgage of the immovable property and charges which makes it mandatory for Mortgagor/ Raghuvar Dyal Singh S/O Bhanu Pratap Singh to seek N.O.C. i.e. No Objection Certificate from the Mortgagee /Aryavart Bank Branch Shree Nivas Dham. 

Central Public Information Officer of the Aryavart Bank may provide the following information point wise as follows.

 

1-Please provide date of application of Mortgagor/ Raghuvar Dyal Singh S/O Bhanu Pratap Singh to seek N.O.C.from Branch Manager Aryavart Bank, Shree Nivas Dham District-Mirzapur, Uttar Pradesh to sell the mortgaged land. 

 

2-Please provide date when Mortgagor/ Raghuvar Dyal Singh S/O Bhanu Pratap Singh was provided N.O.C. i.e. No Objection Certificate  by Branch Manager Aryavart Bank, Shree Nivas Dham District-Mirzapur, Uttar Pradesh to sell the mortgaged land.

5-I pray before the Honourable Sir that appellant sought information under eight  points which have not been provided by the CPIO Aryavart Bank which invites the attention of the First Appellate authority to correct it. It seems that because of corruption culminating into growing non performing assets in the branch such a cryptic and mysterious path is being adopted by the concerned branch manager by colluding with CPIO. Entire requisite documents are attached to this appeal. 
6-It is submitted before the Honourable Sir that Sale of mortgaged property by mortgagor

·         Transfer of Property Act, 1882

The Chapter IV – section 58 to section 104 deals with the mortgage of the immovable property and charges.

·         Mortgage is the transfer of interest in specific immovable property for securing the payment of money;

Mortgagor is the one who mortgages his property i.e. borrower/transferor;

Mortgagee is the one who lends money i.e. lender/transferee;

Mortgage-Money is the principal amount plus interest payable to the mortgagee;

Mortgage Deed is an instrument by which the transfer is effected.

This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray to you, Hon’ble Sir.

It is quite obvious that Raghuvar Dayal Singh son of Bhanu Pratap Singh did not manage to get the no objection certificate from the concerned branch of the aryavart Bank Shrinivas dham district Mirzapur. Since he knew that without no objection certificate he can arrange the registry because of the corruption prevaild in the working of tahsil Sadar and he succeeded. Here concerned bank staff also showed apathy to the recovery of the loan
