SSP BUDAUN MAY KINDLY -
Instead of submitting proper consistent report in the matter concerned sub inspector is submitting arbitrary, inconsistent and misleading reports having no relevance with the points of the grievance. This is deliberate attempt to deviate attention of the supervisory body and the applicant from core issue must be taken seriously by the senior rank officer in the department under the supervision of the senior superintendent of police Budaun.

To curb the misuse of section 151/107/116 of criminal procedure code, the government of Uttar Pradesh in order to comply with the direction of the High court of judicature at Allahabad issued the circular dated 09 September 2021 attached as Page 1 of the attached PDF documents.
How can there be apprehension of a breach of peace because my son who is employed in a company and workplace is Gautam Buddh Nagar Noida? It is quite obvious that police are wreaking vengeance with the applicant because the applicant is submitting a grievance as police are adopting lackadaisical approach to take action against the offenders.
The applicant is making enquiry under article 51A of the constitution of India regarding the misuse of the provisions of law by the concerned police and misleading the senior rank officers in the department by submitting the inconsistent and arbitrary misleading reports in the matter.
1- Provide the posting details of sub inspector Anil Kumar Rana including date of joining in the district-Budaun as well as first posting details when he joined the service of the police with last posting details.
2- Provide the posting details of inspector of police station-Kotwali with name and designation including date of joining in the district-Budaun as well as first posting details when he joined the service of the police with last posting details.
3- Right to reason is an indispensable part of the sound administrative system therefore PIO may provide the reason for unsigned general diary details attached as page 2 of PDF document to this RTI application.
4- Please provide the name and designation of the executive magistrate before whom this unsigned general diary details was submitted by sub inspector Anil Kumar Rana and the executive magistrate accepted it.
5- Land under dispute is the registered land in the name of my husband Vimal Kumar Rastogi but police said in reports that it is a matter of partition. Please provide the reason of it.
6-In sub judice matter in which adjudication is pending before competent court, how can police allow grabbing of land by offenders in the form of new construction ipso facto? Please provide the reason of not registering the F.I.R. after numerous representations of the husband of the aggrieved applicant.
Think about the gravity of situation concerned investigation officer is mentioning the details of a case which adjudication is pending before the appropriate court of the law and having no relevance in the current matter of the land grabbing by the offenders.
Because of the ambiguous report of the investigation officer core issue of the matter remains untouched by the investigation officer which only promotes the corruption in the working of the police and creates a suspense in the working style of the police. In the sub judice matter, offenders are not taking seriously the violations of the provisions of law in the matter in which they themselves filed suit and now police is saying that I should wait the adjudication of the court.
Undoubtedly the applicant and her family members are law abiding citizens will wait for the decision of the court but in meanwhile the police must register First information report against the offenders who grabbed the land by doing construction in the impugned land.
