* Prayer or Relief Sought Sought information by the appellant, provided information by PIO in the office of S.P. Mirzapur and the submissions of the appellant are as follows.
1- Right to reason is the indispensable part of the sound administrative system therefore station house officer must provide the reason for not taking cognizance of the use of JCB by the offenders, quite obvious from reports submitted by police in various grievances.
Provided information by the PIO-No information has been made available by the PIO. Submission of the appellant-Construction has been stayed by the Honourable court but JCB was used by offenders which was in violation of the court order but S.H.O. Jigana failed to provide reason for not taking cognizance of use of JCB even after the complaint of information seeker.
2- After the stay order offenders used JCB and the police are ignoring this illegal act of offenders which is the violation of stay order.
Please provide the action taken by the accountable government staff against the subordinate police personnel.
Provided information by the PIO-Construction of the house is stopped. Submission of the appellant- The matter concerns the use of JCB after the stay order of the court which was the violation of order of court by offenders by taking concerned police under good faith quite obvious from inaction and misleading reports of the police. Thus under this point S.H.O. Jagana provided misleading information through PIO. This act is tantamount to indiscipline.
3-Please provide the reason how the use of JCB by the offenders is justified because concerned police are not taking any action against the offenders by overlooking the repeated requests of the information seeker

4- There are 2 types of evidence of corruption, first is direct evidence and the second is circumstantial evidence. Undoubtedly there is no direct evidence of corruption against the concerned police but there is circumstantial evidence against the police of corruption. The violation of the court order was made by the offenders by taking the concerned police in good faith which resulted in no action by the police against the offenders.
Please provide the reason for overlooking such corrupt deeds of subordinates by the supervisory body in the office of Superintendent of police district Mirzapur.

5- The information seeker requested you to ensure the compliance of the court order but you slapped the information seeker under section 107/116 of the criminal procedure code, misused preventive measures and violated the circulars issued by the government through the office of director general of police.
