It is quite obvious that secretary of the village panchayat submitted arbitrary and inconsistent report and concerned block development officer of the development block Haliya accepted it without taking the perusal of it and blindly forwarded it to the district magistrate Mirzapur. Whether the office of the subdivisional magistrate Lalganj will include the name of the applicant in the family register of the deceased Siyakant Mishra S/O Shambhu Saran Mishra? It is quite obvious that family register is maintained under the ambit of block development officer and custodian of the family register is the secretary of the village panchayat. It is most ridiculous to escape from the matter by the secretary of the village panchayat because of the rampant corruption in the working.

The matter concerns inclusion of the applicant in the family register issued in the name of deceased father of the applicant but it was not done quite obvious from the attached PDF document to the grievance which reflects the mockery of the law and action must be taken against the secretary of the village panchayat. Think about the gravity of situation instead of taking the perusal of the attached PDF document which is the representation of the applicant with the relevant affidavit for the inclusion of the name of the applicant in the family register but because of corruption secretary of the village panchayat is over looking it. In the earlier complaints when the secretary of the village panchayat made contact to the applicant on her mobile number and applicant asked him to include the name of the applicant in the family register he said that you may submit the application along with the relevant affidavit which was followed by the applicant but he is not following the promise made.

The matter concerns the working of the superintendent of police district-Mirzapur to register F.I.R. against offenders who usurped the ancestral land of the applicant by reaping benefit of vulnerability of the applicant.
The details of offenders are as follows.
1-Dayashankar Mishra S/O Shambhu Saran Mishra, Police station-Drummond Ganj, village- Bhaisod Balay Pahad post-Drummond Ganj, tehsil-Lalganj, development block-Halia, District- Mirzapur Uttar Pradesh.
2- Hariprasad Mishra S/O Shambhu Saran Mishra,Police station-Drummond Ganj, village- Bhaisod Balay Pahad post-Drummond Ganj, tehsil-Lalganj, development block-Halia, District- Mirzapur Uttar Pradesh.
3-Lekhpal,Lalganj tehsil, 4-Revenue inspector, Lalganj tehsil and 5-Tehsildar, Lalganj tehsil
The matter concerns usurping of the ancestral land by reaping the vulnerability and immaturity of the applicant does not concern with land dispute but it is criminal offence must be entertained by police to be instrumental in providing justice to applicant. Here ancestral usurped by the brothers of my deceased father by colluding with the Lekhpal, revenue inspector and tahsildar of tehsil Lalganj, district Mirzapur.Please provide justice to the applicant belonging to vulnerable section and setup excellent precedent so that such may not instigate others to destroy the life an adolescent girl whose parents died at tender age.
Class-I heirs-vi. Daughter of predeceased son. The applicant was class-1 heir in the property of my grandfather who died in 2005 but the property was not inherited in favour of the applicant and the applicant was merely 10 years old at that time. They have cheated my entire property dishonestly by colluding with the staff of Tehsil by reaping the vulnerability of the applicant.The report of the concerned investigation officer is arbitrary and not providing justice to the deprived section. Whether the matter of cheating is entertained by the civil court as being suggested by the concerned investigation officer of the police? All the concerned public staff who supported the offenders committed offence under criminal procedure code and Indian Penal Code must be subjected to the penal proceedings by the police to be instrumental in providing justice to a member of the vulnerable section. Here offenders cheated the property of the applicant by reaping the benefits of vulnerability of the applicant which must be taken into account by the police concerned. Where is the justice for the women and girls in the society?

Right to reason is an indispensable part of the sound administrative system, so public information officer must provide the reason for not taking action against offenders under sections 466 467 468 420 195 and 471 of the Indian Penal Code. There is no title dispute between the applicant and opposite party, but a criminal conspiracy to deprive the applicant from the property of her father and police is escaping from the matter by taking recourse that the matter is civil which is illogical.
In 2022, the Supreme Court ruled that daughters have the right to inherit their parents’ self-acquired property and any other property of which they are absolute owners, adding that this rule would apply even in cases where the parents of a daughter died intestate before the codification of the Hindu Succession Act, 1956.
Section 4(2) amendment
The Section 4(2) of the Hindu Succession Act did not include agricultural lands under its scope of inheritance. This was revoked in 2005 by adding the right to claim inheritance over agricultural lands. The Act was amended to ensure greater equality between men and women, so that women could exercise their rights on the lands they have been toiling.

Where is the justice in the Government of Uttar Pradesh to the weaker and downtrodden section especially women and girls? How can a political master claim to provide good governance if in his government there is no safeguard to the women and children.
ReplyDeleteThink about the good governance in government of Uttar Pradesh where the matter concerning the usurping of the ancestral land of a child was thrown into dustbin by taking the recourse that it is a land dispute and it is to be matter dealt in the magistrate court.. here this question arises that why the matter of Hemant Soren was not dealt in the magistrate court? Poor chief minister was sent behind the bar by the enforcement directorate.
ReplyDeleteForgery with the family register causing the deprivation of a person from the property of ancestors is the root cause of concern so action must be taken against sach corrupt practices but who will bell the cat?
ReplyDeleteBlock development officer Haliya is failed to submit proper report in matter of usurping ancestral land of Sadhana Tiwari. The matter concerns usurping of ancestral through forgery which is being overlooked by the concerned police arbitrarily.
