The matter concerns the working of the divisional forest officer District-Mirzapur, Uttar Pradesh. Subject-Several green trees cut down by the offenders illegal consequently F.I.R. must be registered in the light of The U. P. Protection of Trees Act, 1976(U.P. श्रीमान जी इस जनसूचना आवेदन के साथ जो पीडीएफ दस्तावेज संलग्न है उसके दो पेज हैं प्रथम पेज कार्यालय क्षेत्रीय वन अधिकारी लालगंज रेंज मिर्जापुर पत्रांक 19 दिनांक 19 जुलाई 2022 है जिसके अनुसार प्रार्थी के प्रार्थना पत्र पर संबंधित वन दरोगा श्री राम प्रसाद मौर्य ने जांच की उनके जांच रिपोर्ट के अनुसार उन्होंने मौके पर जाकर स्थलीय निरीक्षण किया और यह पाया कि कुछ दिन पूर्व रघुवर दयाल सिंह पुत्र भानु प्रताप सिंह व दिलीप सिंह पुत्र रघुवर दयाल सिंह निवासी ग्राम कोटरा कंतित थाना जिगना जनपद मिर्जापुर के द्वारा बिना अनुज्ञा पत्र के प्रतिबंधित प्रजाति गूलर के वृक्ष का कटान कर दिया गया था जिस पर वन विभाग द्वारा विभागीय कार्यवाही करते हुए रेंज केस संख्या 16/2022-23 दिनांक 2 July 2022 जारी किया गया

1 -श्रीमान जन सूचना अधिकारी प्रभागीय वन अधिकारी मिर्जापुर उपरोक्त केस में संबंधित जांच अधिकारी द्वारा अब तक की गई कार्यवाही का विवरण उपलब्ध कराएं

2-संलग्नक का दुतीय पेज कार्यालय प्रधान मुख्य वन संरक्षक और विभागाध्यक्ष उत्तर प्रदेश लखनऊ पत्र संख्या 48 दिनांक 20 जुलाई 2022 है जो प्रभागीय वन अधिकारी मिर्जापुर वन प्रभाग मिर्जापुर को संबोधित है

उपरोक्त द्वारा जन सूचना अधिकारी कार्यालय प्रधान मुख्य वन संरक्षक और विभागाध्यक्ष उत्तर प्रदेश लखनऊ ने प्रार्थी के जनसूचना आवेदन को प्रभागीय वन अधिकारी मिर्जापुर को भेजा था जैसे कि जनसूचना आवेदन में प्रार्थी द्वारा मांगी गई सूचना का समुचित जवाब मिल सके क्योंकि प्रभागीय वन अधिकारी मिर्जापुर द्वारा उपलब्ध कराई गई सूचना भ्रामक और अधूरी थी इसलिए प्रार्थी द्वारा दिनांक 7 अक्टूबर 2022 को अपील प्रस्तुत किया गया और उस अपील को 19 अक्टूबर 2022 को जन सूचना अधिकारी द्वारा पुनः प्रभागीय वन अधिकारी मिर्जापुर को भेजा गया

श्रीमान जी प्रार्थी को यह सूचना उपलब्ध कराई जाए कि प्रथम अपीलीय अधिकारी द्वारा ट्रांसफर की गई अपील पर प्रभागीय वन अधिकारी मिर्जापुर द्वारा क्या कार्यवाही की गई क्योंकि अभी तक उनके स्तर से प्रार्थी को कोई भी कार्यवाही प्रार्थी को अप्राप्त है

श्रीमान जी प्रार्थी को उपरोक्त दोनों बिंदुओं की सूचना तत्काल उपलब्ध कराई जाए जिसके लिए प्रार्थी सदैव श्रीमान जी का आभारी रहेगा

Here PIO means D.F.O. Mirzapur provided incomplete and misleading information as point 1 and 2 has been covered by him but information sought from him is still awaited. Please direct D.F.O. Mirzapur to provide the rest of information at the earliest. PIO in the office of divisional forest officer Mirzapur may provide access to information-to-information seeker within stipulated time as prescribed under subsection 1 of section 7 of Right to Information Act 2005.

Now it has been proved that offenders cut green trees without prior permission of the department and sold it to timber merchants and one of them is prohibited to cut. Therefore, action needed in the matter in the time bound manner.

3-The U. P. Protection of Trees Act, 1976 aimed to protect ecology and environment and its provisions are protected by the department of forest by taking help of the police concerned.

Please provide the action taken report regarding grievances made by the information seeker quite obvious from the attached document to the RTI Application.

4-Everyone knows the government gives paramount importance to protection of the ecology and environment consequently it is obligatory duty of the public staff to remain vigilant to curb illegal cutting of green trees.

Thanks for not procrastinating on my representation but portion of communication containing information regarding the processing in court and court information is explicit. Thanks for helping to the government and frustrating the unscrupulous elements having no regard to nature because of selfish nature. I do not like those who are destroying our ecology badly because of their demon like mind. Undoubtedly, they will learn some lesson from your initiative.
