The authority concerned is directed to take appropriate action within 8 weeks associating the complainant/victim and to inform him/her of the action taken in the matter. Accordingly, I am attaching a scanned copy of the complaint/intimation for necessary action as per the directions of the Commission. As informed earlier by Shubhra Tyagi Goel ASSISTANT REGISTRAR of National Human Rights Commission. An application on behalf of Vandana Singh W/O Mr. Rajkumar Singh D/O Nandlal Singh under Article 51 A of the constitution of India to seek status of the case cum First Information Report and justice concerned with domestic violence because of the dowry demand on the part of in-laws and drunkard husband living separate from her husband at the place of her parents home for ten years because apprehension of dowry death. To Commissioner of police, Ahmedabad Address- Near Petrol Pump, Shahibaug, Ahmedabad, Gujarat, India Subject-Regarding investigation as F.I.R. registered as FIR No. Part A 11191030210051/2021 by the Mahila Police Station, District-Ahmedabad city in the year 2021.under section-498 A, 323, 294 KH, Subsection 2 of section 506 and 114 of Indian Penal Code and Prohi. Act accordingly. Honourable commissioner Sir, the aforementioned order passed on Tue, Nov 23, 2021 at 10:35 AM in the Case No.877/6/1/2021-WC and you had to comply with the order within 8 weeks under intimation to either complainant Yogi M. P. Singh or victim Vandana Singh. Sir, neither you intimated the complainant Yogi M. P. Singh nor victim Vandana Singh which implies that you took under teeth the order passed by the National Human Rights Commission. There are two types of evidence of corruption. 1-Direct 2-Indirect or circumstantial evidence. Undoubtedly the complainant has no direct evidence of the bribes taken by the staff of the department of the police concerned but there is ample evidence of rampant corruption in the department of police which can be argued by the complainant before the competent authorities if some one may take cognizance. Matrimonial Cruelty in India is a cognizable, non-bailable and non compoundable offence. It is defined in Chapter XXA of I.P.C. under Sec. 498A as: Husband or relative of the husband of a woman subjecting her to cruelty. Whoever being the husband or the relative of the husband of a woman, subjects her to cruelty shall be punished with imprisonment for a term, which may extend to three years and shall also be liable to a fine. The section was enacted to combat the menace of dowry deaths. It was introduced in the code by the Criminal Law Amendment Act, 1983 (Act 46 of 1983). By the same Act section 113-A has been added to the Indian Evidence Act to raise presumption regarding abetment of suicide by married woman. The main objective of section 498-A of I.P.C is to protect a woman who is being harassed by her husband or relatives of husband. Cr.P.C. Chapter XII S. 173 Report of police officer on completion of investigation Description Every investigation under this Chapter shall be completed without unnecessary delay. As soon as it is completed, the officer in charge of the police station shall forward to a Magistrate empowered to take cognizance of the offense on a police report, a report in the form prescribed by the State Government, More than six months have passed since the date police recorded the statement of the victim but offenders are running scot-free

On the one side of a screen our political leaders talk of constitution but on the other side of the screen they themselves do not regard the provisions of the constitution because of the corruption which is promoted by our corrupt government functionaries in the government machinery to fill their own pockets quite obvious from their cryptic working style.

  3. Whether Gujarat police has not failed to provide justice to vulnerable ladies who are victims of domestic violence because of dereliction of the police concerned? Undoubtedly it is corruption as police are not showing keenness to be instrumental in providing justice to vulnerable ladies, quite obvious from the current matter.
