* Description of Information Sought According to the investigation officer, section 307 of the I.P.C. was substituted section 323, 504,506 of the I.P.C. and reason was given police could not collect evidence.. Provide the following information point wise as sought.
1-Police may provide the medical report submitted before the court in the matter.
2-.Whether to drop out of section 307 is the sole prerogative of the investigation officer if yes provide the detail of the competent police officer who allowed the mockery of law and given freedom to sabotage the warrant case into summon case and paved way to shield the offenders.
3-Whether any court of law passed an order to drop out section 307 in the matter if passed, provide the copy of the order and also provide the copy of the order if senior rank police personnel passed the order to drop out section 307.
4-Whether quantum of injuries inflicted on the aggrieved by the offenders proved on medical report is the ground of drop out section 307 or cryptic arbitrary report of the investigation officer prepared by colluding with the offenders. Please provide reason if any provided by the investigation officer to drop out section 307.
5-F.I.R. against four offenders but charge sheet against only three, provide the reason of prosecuting agency and available comments of its investigation officer.

ReplyDeleteUndoubtedly it is reflecting rampant corruption in the department of police in the Government of Uttar Pradesh which is quite obvious from the cryptic working style of the police.
ReplyDeleteIt is quite obvious that public information officer in the office of police commissioner Lucknow initially concealed the information from the aggrieved applicant because they know that if the aggrieved applicant will know about the corruption which is being carried out by them he will be alert and he will oppose the conversion of section 307 into the section 323, 504 and 506.
Undoubtedly police is playing negative role in the matter as it has diluted the case by favouring the culprits as they have changed the warrant case into a summon case which is a mockery of the law of land.
ReplyDeleteUndoubtedly it is a serious irregularity committed by concerned investigation officer by taking under good faith to the senior rank officers in the department.
Undoubtedly Anti social elements committed serious crimes but Police set them scot-free.
Here police itself committed serious offence by reducing the quantum offence which was punishable under section 307 of the Indian Penal Code now punishable under section 323, 504 and 506 which means they set scot free offenders because of rampant corruption in the department of police in the state of Uttar Pradesh. Whether such corrupt practice in the state of Uttar Pradesh of the police in the state will not increase the moral of the offenders.
