अपीलार्थी श्री दिनेश प्रताप सिंह पता सुरेकापुरम, जबलपुर रोड, संग मोहाल पोस्ट आफिस, पिनकोड-231001 द्वारा सूचना का अधिकार अधिनियम-2005 की धारा-6(1) के अन्तर्गत सूचना चाही गई है। प्राप्त ऑनलाइन आवेदन पत्र सम्बन्धित जनसूचना अधिकारी को अन्तरित किया जा चुका है। नियमानुसार निर्धारित अवधि में सूचना न प्राप्त होने/सूचना से असंतुष्ट होने पर आवेदक द्वारा दिनांक 03.02.2024 को ऑनलाइन प्रथम अपील आवेदन किया गया, जिसके क्रम में ऑनलाइन प्राप्त प्रथम अपील की सुनवाई दिनांक 20.03.2024 को नियत करते हुए अपीलकर्ता को सुनवाई हेतु सूचना प्रेषित की गई। सुनवाई की नियत तिथि पर अपीलकर्ता उपस्थित नहीं हुए। सम्बन्धित जनसूचना अधिकारी / उनके प्रतिनिधि उपस्थित हुए। सुनवाई के समय पत्रावली के परिशीलन से विदित हुआ कि अपीलार्थी को सूचना प्रेषित किये जाने का कोई अभिलेखीय साक्ष्य पत्रावली में उपलब्ध नहीं है।

अतः आदेशित किया जाता है कि प्रभारी अधिकारी, कानपुर रोड योजना / ज०सू०अ०, ल०वि०प्रा० इस आदेश के पारित होने के 15 दिवस के अन्दर आवेदक के ऑनलाइन आवेदन के सापेक्ष नियमानुसार प्रदाय किये जाने योग्य सूचनाएं अपीलार्थी को उपलब्ध कराएं।

तद्नुसार प्रश्नगत ऑनलाइन प्रथम अपील निस्तारित की जाती है।

* Prayer or Relief Sought From the following status, it is quite obvious that appellant submitted the RTI application on 25th October 2023 which was forwarded by the nodal officer to the concerned public information officer on the same date but it is most unfortunate that concerned public information officer did not entertain that application up till now which is a mockery of the provisions of the Right to Information Act 2005 such practices must be curbed by the accountable staff of the Lucknow development authority. It is quite obvious that more than 3 months passed, but it is most unfortunate that the public information officer did not provide any information to the information seeker which is a violation of subsection 1 of Section 7 of the right to Information Act 2005. The Right to Information Act 2005 was introduced by the government of India to promote transparency and accountability in the working of the public authorities but it could not achieve its objective in 18 years because of the rampant corruption in the working of public authorities in the government. It is quite obvious that there is no fear of penal action in the mind of the public information officer working in the office of Lucknow Development Authority because of the corruption in the government. Our public staff do not like transparency and accountability in their working because of the corruption in their working and if the government is really interested to curb the corruption in the government machinery, then our accountable public functionary must pursue the provisions of the right to information act instead of diluting its provisions. The right to information act 2005 is the power vested to the citizens of the country provided by the government to the citizens through proper legislation, but it is quite obvious that corrupt government functionaries do not like this provision and hatch conspiracy to dilute it, this is the root cause, public information officers inspired by such corrupt public functionaries, withhold information from Information Seekers. This is a humble request of the appellant to the first appellate authority to direct the public information officer to provide the information to the appellant and also initiate disciplinary proceedings against the public information officer for violating the provisions of the right information act 2005 against the public information officer.

  1. It seems that Yogi government in Uttar Pradesh has put the right to information act into a dustbin which is quite obvious from the long progression of the public information officer of the Lucknow development authority.

  2. Similar order was passed by the first appellate authority to provide information within 15 days last time and that order was not complied by the public information officer in Lucknow development authority.

Right to Information act 2005 was introduced by the government of India during the regime of Congress but when the Modi government came into power it treated The right to Information act with step motherly treatment which was not fine to the people in the state. The power given by the Congress government was snatched by Modi government from the people.
