कृपया आई०जी०आर०एस० के अन्तर्गत पी०जी० पोर्टल पर प्राप्त संदर्भ संख्या 60000240059790 दिनांक 05.04.2024 का अवलोकन करने का कष्ट करें, जिसमें शिकायतकर्ता श्री योगी एम०पी० सिंह निवासी मो० सुरेकापुरम् कालोनी लक्ष्मी नारायन बैकुण्ठ महादेव मन्दिर रींवा रोड, मीरजापुर के द्वारा वांछित सूचना प्राप्त न होने की दशा में मा० राज्य सूचना आयोग में वाद दायर किया गया है। तत्कम में मा० रजिस्ट्रार, उ०प्र० राज्य सूचना आयोग लखनऊ के आदेश संख्या 10890 / रा०सू०आ०/ शास्ति अनु/ रजिस्ट्रार/2018 दिनांक 30.11.2018 द्वारा तत्समय दिनांक 01.08.1012 में पदस्थ मुख्य विकास अधिकारी, जनपद-मीरजापुर के वेतन से अधिरोपित अर्थदण्ड रू0 25000/- की वसूली कराये जाने की अपेक्षा की गयी है।
उक्त के क्रम में सादर अवगत कराना है कि तत्समय दिनांक 01.08.2012 को इस जनपद में डा० एस०के० पाण्डेय मुख्य विकास अधिकारी के पद पर कार्यरत थे, जिनका स्थानान्तरण इस जनपद से दिनांक 28.02.2013 को हो गया है। मा० आयोग द्वारा अर्थ दण्ड के वसूली का आदेश दिनांक 30.11.2018 को पारित किया गया है। ऐसी स्थिति में डा० एस०के० पाण्डेय तत्कालीन मुख्य विकास अधिकारी, मीरजापुर के वेतन से वसूली कराया जाना इस जनपद से सम्भव नहीं है।
अतः कृपया उपरोक्तानुसार वस्तुस्थिति से अवगत होते हुये प्रकरण इस स्तर से निक्षेपित कराने का कष्ट करें।

It is quite obvious that the matter concerns the working of the district magistrate Mirzapur and the order passed by the Uttar Pradesh State Information Commission which compliance was to be made by the district Magistrate Mirzapur quite obvious from the attached government order as first two pages of the attached pdf document to the complaint.
In the following complaint district Magistrate Mirzapur through chief development officer Mirzapur submitted an arbitrary and inconsistent report in the matter which is tantamount to indiscipline so action must be taken against the chief development officer who is submitted an inconsistent report on the portal without taking the perusal of the contents of the grievance.

Grievance Description-The matter concerns the working of the district Magistrate Mirzapur who did not make compliance of the order passed by the Uttar Pradesh State Information Commission which is tantamount to indiscipline.
This matter concerns the recovery of rupees 25,000 from the Public information officer Chief Development Officer District -Mirzapur imposed by Uttar Pradesh state information commission which has not been complied in five years.
The matter concerns the non-compliance of the order passed by Uttar Pradesh state information commission in the matter appeal number-S-11-408/C/2011, Registration number-233942.In this case/appeal the appellant was the applicant, and the opposite party was Public information officer Chief Development Officer District -Mirzapur.
सूचना अधिकारी के वेतन से अर्थदण्ड की वसूली सुनिश्चित करें और अर्थदण्ड की धनराशि को नियत दिनांक तक निम्न लेखा शीर्षक में जमा कराएं-
0070-अन्य प्रशासनिक सेवायें-60-अन्य सेवायें-800-अन्य प्राप्तियाँ-15-सूचना का अधिकार अधिनियम, 2005 के अधीन अधिरोपित शास्तियाँ
(2) प्रत्येक विभाग के अपर मुख्य सचिव/प्रमुख सचिव/सचिव का यह दायित्व होगा कि वह अपने विभाग के किसी जन सूचना अधिकारी पर आयोग द्वारा अर्थदण्ड अधिरोपित किए जाने की दशा में उक्त जन सूचना अधिकारी के वेतन से अर्थदण्ड की धनराशि वसूली कराएं। इसी प्रकार प्रत्येक विभागाध्यक्ष का यह दायित्व होगा कि वह संबंधित विभाग के किसी जन सूचना अधिकारी पर आयोग द्वारा अर्थदण्ड अधिरोपित किए जाने की दशा में उक्त जन सूचना अधिकारी के वेतन से अर्थदण्ड की वसूली कराएं। इसी प्रकार प्रत्येक मण्डलायुक्त एवं प्रत्येक जिलाधिकारी का यह दायित्व होगा कि उनके मण्डल अथवा उनके जनपद में नियुक्त किसी जन सूचना अधिकारी पर यदि उत्तर प्रदेश सूचना आयोग द्वारा अधिनियम की धारा-20 के अन्तर्गत अर्थदण्ड अधिरोपित किया जाता है तो वह अर्थदण्ड की वसूली उक्त जन सूचना अधिकारी के वेतन से कराएं। अर्थदण्ड वसूली के उपरान्त संबंधित नियंत्रक प्राधिकारी द्वारा इस सम्बन्ध में अनुपालन आख्या आयोग के रजिस्ट्रार को अविलम्ब प्रेषित की जाएगी।
(3) 30प्र0 सूचना आयोग द्वारा अधिरोपित अर्थदण्ड से सम्बन्धित विभागवार सूचना आयोग की वेबसाइट पर प्रत्येक माह के अन्त में अपलोड की जाएगी। आयोग की वेबसाइट से आयोग द्वारा अधिरोपित अर्थदण्ड की सूचना सीधे प्राप्त कर उससे सम्बन्धित अनुश्रवण का कार्य अपर मुख्य सचिव/ प्रमुख सचिव/सचिव द्वारा शासन स्तर पर तथा विभागाध्यक्ष द्वारा विभागाध्यक्ष स्तर पर प्रत्येक माह सुनिश्चित किया जाएगा।
(4) 30प्र0 सूचना आयोग के स्तर पर अर्थदण्ड की वसूली के अनुश्रवण से सम्बन्धित कार्य सचिव, उ0प्र0 सूचना आयोग द्वारा स्वयं अपने स्तर पर नियत समय में सुनिश्चित किया जाएगा। ऐसे मामले जिनमें वसूली नहीं हो पाई है, इन वसूली के मामलों के सम्बन्ध में सचिव, उ0प्र0 सूचना आयोग द्वारा सम्बन्धित नियंत्रक अधिकारी को अवगत कराया जाएगा। अर्थदण्ड की वसूली का उत्तरदायित्व सम्बन्धित नियंत्रक अधिकारी का ही होगा।
(5) प्रत्येक वित्तीय वर्ष के अन्त में सचिव, 30प्र0 सूचना आयोग द्वारा प्रशासनिक सुधार विभाग, उ०प्र० शासन को ऐसे प्रकरणों की सूची उपलब्ध कराई जाएगी जिन प्रकरणों पर सतत अनुश्रवण किए जाने के पश्चात् भी अनुपालन आख्या नहीं प्राप्त हुई है। प्रशासनिक सुधार विभाग द्वारा उन प्रकरणों से सम्बन्धित विभागों को शास्ति की वसूली हेतु निर्देश प्रेषित किए जाएँगे।

According to the report of district development officer Mirzapur, On 1st August 2012 Dr S K Pandey was posted as the chief development officer in the district who has been transferred on 28th February 2013 to the other place. Honourable Uttar Pradesh state information commission passed the order of recovery on 30th November 2018. Under such circumstances recovery of the penalty from the celery of Dr S K Pandey who was posted as the chief development officer in the district cannot be feasible from his salary currently in the district because he has been transferred. Whether such absurd report is not reflecting jungle raj in the government of Uttar Pradesh where pecuniary penalty imposed by the Information Commission is not being recovered on the flimsy ground that the wrongdoer chief development officer has been transferred from district. Information Commissioner is a constitutional functionary and order must be complied by government staff by informing concerned district magistrate.
