* Prayer or Relief Sought It is quite obvious that following RTI application was forwarded to the Superintendent of police district Mirzapur by the office of director general of police, but it is most unfortunate that as usual office of the Superintendent of police taken this communication under teeth by providing the report of the sub inspector to justify his arbitrary and illegal stand instead of providing 4 point information to the appellant.

1-Most respected Sir, the distance between Mirzapur and Dramandganj is 51 kilometers and the applicant is a woman. How can your applicant create nuisance in Dramand Ganj at the site of dispute which means at the native place of the applicant?
Please provide the date and time when the applicant visited the native place in the time span of 3 years.
2-it is quite obvious that the applicant is a woman and seeking justice from the police and police concerned to demoralize the applicant implicated her and her husband under preventive measures with ulterior motive to harass the applicant. Right to reason is an indispensable part of the sound administrative system, so public information officers must provide the reason for not taking action against offenders under sections 466 467 468 420 195 and 471 of the Indian Penal Code.
3-Public information officer must provide the posting details and date of joining the district Mirzapur with date of joining of police station-Dramand Ganj of Sub inspector Mr Arvind Kumar Saroj.
4-Public information officer must provide the reason how the application of the section 107 and 116 is not the blatant misuse by the concerned police officer as right to reason is the indispensable part of sound administrative system as well as it encroached the fundamental right of a woman, seeking justice from the government.
It is quite obvious that public information officer circle officer Lalganj district Mirzapur instead of providing information to the information seeker submitted the report of the station house officer Dramandganj district-Mirzapur who only justified his stand by supporting the illegal stand of the subordinate staff who submitted arbitrary report on the Jansunwai portal of the government of Uttar Pradesh.

Think about the gravity of situation not a single point in formation was made available by the public information officer to the victim Sadhana Tiwari then one can easily guess it what is the situation of the justice delivery system in the Government of Uttar Pradesh. It seems that government functionaries in the state of Uttar Pradesh has put the right to information act 2005 into the heap of a garbage.
ReplyDeleteSometimes it is experienced that police have thrown the right to Information Act 2005 into a dust bin which is the Root-Cause public information officers in Department of police are not providing any information to the information seekers under transparency act. The government introduced the right to information act 2005 to promote transparency and accountability in the working of the public authorities but it seems that because of the rampant corruption in the government machinery this act will never achieve its goal.
ReplyDeleteIt reflects the negligence of duty and action must be taken against such erring staff of the police. It is quite obvious that Public information officer, circle officer Lalganj took under teeth the provisions of right to information act by deliberately not providing information to the information seeker.
