Prayer- Public information officer did not entertain RTI application within time 30 days as prescribed under subsection 1 of section 7 of the right to information act 2005 and still they have not provided any information.

Short submissions of the appellant are as follows.

1-Most respected sir following is the current status of the RTI application submitted by the appellant online which was forwarded by the nodal officer to the concerned public information officer on 30th November 2023.

2- Here concerned public information officer is the deputy director of Agriculture district Mirzapur Uttar Pradesh. Registration Number DRAGR/R/2023/60104 Name Yogi M P Singh Date of Filing 18/11/2023 Status REQUEST FORWARDED TO PIO as on 30/11/2023 Details of PIO :- Telephone Number:- 7839882478, Email Id:- ddamzp2012@gmail.com Note :- You are advised to contact the above mentioned officer for further details. 

3-It is quite obvious that if the nodal officer forwarded the rti application on 30th November 2023 and it is 25th January 2024 which means near above 2 months passed but the concerned public information officer did not provide the information to the information seeker. Consequently, the public information officer, deputy director of Agriculture District Mirzapur violated subsection 1 of section 7 of the right to information act 2005. 

4-It is quite obvious that whatever information is being sought by the appellant concerns the deep rooted corruption in providing the PM Kisan Saman Nidhi to the beneficiaries. The public information officer deputy director of Agriculture District Mirzapur is not providing information to the appellant to conceal its corruption, but he must know that right to information at 2005 was introduced by the government of India to promote transparency and accountability in the working of public authorities so that rampant corruption in the working of public authorities may be controlled. 

5-This is a humble request of the appellant to the respected state information commissioner to direct the public information officer, deputy director of Agriculture District Mirzapur to provide the information to the appellant. Since the public information officer, deputy director of Agriculture district- Mirzapur violated subsection 1 of section 7 of the right to information 2005 so pecuniary penalty must be imposed under section 20 of the right to information act 2005 against him.

6- The appellant sought following information from the public information officer.

1- Whether an individual can reap the benefits of two beneficiaries under the Prime Minister Kisan Samman Nidhi scheme is quite obvious from the attached beneficiaries list to the online RTI application. Please provide the copy of such provision. 

2- Please provide the verification details of the beneficiaries of the prime minister kisan Samman Nidhi in the village panchayat Nibi Gaharwar in the last five years which must also include the name and designation of the staff who did the verification of the beneficiaries.

3- Whether the attached list has been verified by the staff of the department if verified then provide the designation and the name of the staff who verified this list. 

4- Provide the criteria for the selection of the beneficiaries of the prime minister Kisan Salman Nidhi scheme of the government of India. 

5- Whether the farmers without land may be beneficiary of the Prime Minister Kisan Samman Nidhi scheme if yes then provide the provision, circular, office memo, government notifications and orders which support it.

This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray for you, Hon’ble Sir.
