विषय-महोदय छात्रों का फीस तो महात्मा गांधी काशी विद्यापीठ इतनी त्वरित गति से बढ़ाता है कि उसके सामने अन्य विश्वविद्यालय पीछे हो जाएं किंतु जब फंड खर्च करने की बात आती है तो आप रुपए की जगह 25 पैसे खर्च करते हैं सोचिए शिक्षा का स्तर आप नहीं उठाना चाहते हैं हम कहते हैं कि जब तक अध्यापक स्थाई नहीं होंगे उनके कार्य में जिम्मेदारी कैसे आएगी जब तक वह दैनिक वेतन भोगी शिक्षक की भाति पढ़ाएंगे तो उनके अंदर पद के प्रति जवाबदेही इसलिए नहीं आएगी क्योंकि उनके स्तर से उन्हें बहुत ही निम्न वेतन दिया जा रहा है इसलिए आप शिक्षकों के नियुक्ति संबंधी स्थिति को स्पष्ट करें कृपया प्रश्न गत प्रकरण को गंभीरता से लें और बिंदुओं पर प्रकाश डालें
There is a separate fund allocation by the University grant commission to the state university in the Government of Uttar Pradesh. These funds are utilised to improve the curricular activities in the affiliated colleges by the University. Since the matter concerns the wide public interest so the applicant under Article 51 A of the constitution of India is making enquiry to the accountable staff of the Mahatma Gandhi Kashi Vidyapeeth University Varanasi regarding the appointment of teachers in the affiliated college as described below. The appellant knows well that the sought information concerning the working of the M.G.K.V.P. University Varanasi so it must be made available by the public information officer M.G.K.V.P. University Varanasi or he may forward the matter to the principal K.B..P. G. College Mirzapur to provide information to the information seeker if PIO deems the matter is closely connected to the working of the Principal K.B.P.G. College Mirzapur. Reply -

Description of Information Sought The matter concerns appointment of permanent teachers and daily wage teachers as well as appointment of class 3 and 4 employees and temporary posting of class 3 and 4 employees in Kanhaiya Lal Basant Lal post graduate college in short K. B. P. G. Mirzapur. district Mirzapur. Public information officer in Mahatma Gandhi Kashi Vidyapeeth Varanasi may provide the following information to the information seeker. 1-Public information officer may provide the list of parmanent teachers in kbpg college Mirzapur. 2-Public information officer may provide the list of daily wage staff who have been appointed on the ground of honorarium provided by the government. 3-Public information officer may provide the list of adhoc posted teachers in the kbpg college Mirzapur. 4-Public information officer may provide the list of the teachers who were appointed daily wage staff but now active as the permanent teacher and date when they were made permanent. 5-Similar list may be provided by the public information officer in regard to the class 3 and 4 employees of the kbpg college Mirzapur as sought by the information seeker under point 1, 2, 3 and 4. The information seeker request the public information officer to provide the information point wise within stipulated time as prescribed under subsection one of section 7 of the right to information act 2005. I expect that if there is transparency and accountability in the working of the Mahatma Gandhi Kashi Vidyapeeth University Varanasi then concerned public information officer will provide the aforementioned information point wise as sought by the information seeker.

Reply :- आप द्वारा मांगी गयी सूचना के सम्बन्ध में अवगत कराना है कि के0बी0पी0जी0 कालेज, मिर्जापुर अनुदानित महाविद्यालय के श्रेणी में है, जहाँ जनसूचना अधिकारी अधिकृत है। अतः सम्बन्धित सूचना महाविद्यालय से प्राप्त की जा सकती है।
According to subsection 3 of section 6 of the Right to Information Act 2005 states as follows. Where an application is made to a public authority requesting for an information,— (i) which is held by another public authority; or (ii) the subject matter of which is more closely connected with the functions of another public authority, the public authority, to which such application is made, shall transfer the application or such part of it as may be appropriate to that other public authority and inform the applicant immediately about such transfer: Provided that the transfer of an application pursuant to this sub-section shall be made as soon as practicable but in no case later than five days from the date of receipt of the application. Here it is quite obvious that public information officer M.G.K.V.P. University Varanasi violated subsection 3 of section 6 of the Right to Information Act 2005.
