Subject-Please direct the appropriate authority to check the mismanagement in the working of the Basic Shiksha Adhikari and his subordinates in the management of Kasturba Vidyalaya as caused the death of adolescent girl student in the Kasturba Vidyalaya Kachhwan District-Mirzapur, Uttar Pradesh.
With due respect, the applicant invites the kind attention of the Honourable Sir to the following submissions as follows.
1-I pray before the Honourable Sir that 51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;(i) to safeguard public property and to abjure violence;
(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.
2-It is submitted before the Honourable Sir that Right to life is not only constitutional right but also human right which must be protected but here girl student died because of mismanagement in the working of the B.S.A. Mirzapur but no subordinates of the B.S.A. Mirzapur were made accountable except poor teeth less warden who had no power to take the decisions and spend the funds.
3-I pray before the Honourable Sir that the applicant made the enquiry regarding the tragic incidence occurred but Block level officer of the Block-Kachhwan District-Mirzapur submitted report which do not fix the accountability of those staff accountable for the mismanagement in Kasturba Vidyalaya at Kachhwan caused the untimely demise of the adolescent girl student which snatched her rights to live in this world.
4-It is submitted before the Honourable Sir that here the matter concerns the medical facilities provided in the Kasturba Vidyalaya for students belonging weaker and downtrodden section and government is spending huge fund on the such institutions.
5-I pray before the Honourable Sir that it is quite obvious that Tri level committee setup by B.S.A. for enquiry in the matter found only contract worker Asha Yadav accountable for death of adolescent girl in Kasturba Vidyalaya Kachhwan and put the matter concerning the mismanagement into heap of garbage. Here facilitator is not contract worker Asha Yadav but facilities are provided by B.S.A. Mirzapur itself under the monitoring of his subordinates at the level of blocks under monitoring of block level education officer.
6-It is submitted before the Honourable Sir that following grievance was submitted by the applicant but it was closed by submitting concocted story instead of thoroughly checking the mismanagement in the working of the public authority because it was an internal enquiry committee. Please take a glance of the following complaint and report submitted in the matter annexed to this petition.

With due respect the applicant wants to draw the kind attention of the Basic Shiksha Adhikari district Mirzapur to the following points.
1-Being the accountable officer of the department in the district Mirzapur Basic Shiksha Adhikari may tell the applicant about the steps taken by him in regard to untimely demise of the adolescent girl studying in the Kasturba Gandhi Vidyalaya
2-Basic Shiksha Adhikari district Mirzapur may tell the applicant regarding the steps taken by the department in regard to enquiry to check the allegations made by the guardians of the student concerning the mismanagement on the part of the department.
3-Whether any departmental enquiry has been ordered by him to check the suspicious death of the diseased student so that suspicion may end as it questions the management of the department and implementation of the fund provided by the government. amarujala.com
मिर्जापुर अपना शहर कस्तूरबा गांधी विद्यालय की छात्रा की संदिग्ध परिस्थितियों में मौत, परिजनों ने विद्यालय प्रशासन पर लापरवाही का आरोप लगाया
संवाद न्यूज एजेंसी कछवां । महामलपुर गांव स्थित कस्तूरबा गांधी विद्यालय में कक्षा आठ की छात्रा की शनिवार की दोपहर संदिग्ध हालात में मौत हो गई। परिजनों ने विद्यालय प्रशासन पर लापरवाही का आरोप लगाया है। जबकि विद्यालय के लोगों को कहना हे कि तबीयत खराब होने से ही उसकी मौत हुई है। भदोही जिले के ज्ञानपुर नेवादा गांव निवासी कृष्ण कुमार पानीपत में कार्य करते हैं। उनकी एक पुत्री मुस्कान 14 कछवां के भदोही के ज्ञानपुर नेवादा गांव की रहने वाली थी छात्रा मुस्कान महामलपुर स्थित कस्तूरबा गांधी विद्यालय में कक्षा आठ में पढ़ती थी, जबकि दूसरी पुत्री महिमा इसी विद्यालय में कक्षा सात की छात्रा है।
12 जनवरी को दोनों बहनें घर गई थीं। 18 जनवरी को विद्यालय वापस आई शनिवार की सुबह मुस्कान की तबीयत खराब हो गई। इसके बाद विद्यालय प्रशासन के लोग उसे बिलखती मुस्कान की दादी संवाद सीएचसी कछवां ले गए। वहां हालत गंभीर होने पर मंडलीय अस्पताल रेफर कर दिया गया। मंडलीय अस्पताल पहुंचने पर डाक्टर ने मृत सूचना पर पहुंचे परिजनों ने लापरवाही का आरोप लगाया। छात्रा के दादा अंगनू ने बताया कि शुक्रवार से तबीयत खराब थी। लेकिन, उन लोगों को देर से जानकारी दी गई। शनिवार की सुबह जानकारी मिलने पर पहुंचे तो वह सीएचसी से रेफर हो रही थी। उसके मुंह से झाग निकल रहा था। परिजनों ने जांच की मांग की। वार्डन ने बताया कि शुक्रवार की रात को तबीयत खराब हुई थी। शनिवार को सांस लेने में दिक्कत होने पर उसे अस्पताल ले जाया गया। पुलिस ने शव को पोस्टमार्टम के लिए भेज दिया। जिला समन्वयक केशराज सिंह ने बताया कि छात्रा तीन दिन से बीमार थी। शनिवार की सुबह उसे सीएचसी और वहां से मंडलीय अस्पताल लाया गया, जहां उसकी मौत हो गई।
I expect that the concerned officer of the department of basic education will take into account this application concerning the untimely demise of the girl student. Everyone knows that a huge fund of the government is flowing into the Kasturba Gandhi Vidyalaya for the students belonging to the weaker and downtrodden section but such mismanagement rocked the entire society. If the facilities were not available in the institution then it was obligatory duty of the concerned staff to inform the guardians of the student but it was not done quite obvious from the allegations made by the guardians of the diseased student. Think about the gravity of situation how did they sleep in the night when the concerned student was at the stage of struggling for life.

This is a humble request of your applicant to you, Hon’ble Sir, how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.
