Reply :- Whereas On-line First Appeal No. CPCOI/A/E/22/00006 dated 19.10.2022 has been preferred by Shri Yogi M.P. Singh (hereinafter referred to as “Appellant”) before the undersigned, First Appellate Authority [FAA], with regard to Central Public Information Officer [CPIO]’s response dated 15.11.2022 to the Appellant’s online RTI application dated 21.10.2022.

2. Whereas the Appellant vide his on-line RTI Application No. CPCOI/R/E/22/00033 dated 21.10.2022, had inter alia sought information and the CPIO vide letter No.1350-E33/RTI/CCI(YogiMPSingh)/2022-23 dated 15.11.2022, responded to the Appellant and the information sought was furnished.

3. In the Memorandum of Appeal, the Appellant has alleged that he has been provided misleading information.

4. I have perused the RTI Application dated on 21.10.2022, response of the CPIO vide letter dated 15.11.2022 and the instant Appeal received on 19.11.2022 preferred by the Appellant wherein he has alleged that CPIO has provided misleading information.

5. From the perusal of your RTI Application dated on 21.10.2022 and response of the CPIO vide letter dated 15.11.2022, I am satisfied that the response of CPIO does not suffer from any infirmity, as CPIO has responded adequately to the RTI application of the appellant.

6. No interference is warranted, and the appeal stands dismissed, accordingly.

Undoubtedly in this age of globalization, competition among the business rivals is at its peak. Corruption because of greed among the public staff mushrooming in our country and abroad and rival competitors are reaping benefits of it. Consequently, raised questions and seeking information.

4-Government itself taking arbitrary steps to take google under pressure is an unhealthy practice.

The Government of India must take action against Google if it is creating its monopoly by breaking set up norms as such practices can never be in the interest of common consumers and smaller competitors.

Nearly two months passed but the Government did nothing only a media stunt for cheap popularity. Whether the government issued a recovery notice against Google as required under the law as told by them?

The Competition Act, of 2002, as amended by the Competition (Amendment) Act, of 2007, follows the philosophy of modern competition laws. The Act prohibits anti-competitive agreements, and abuse of dominant position by enterprises and regulates combinations (acquisition, acquiring of control and M&A), which cause or are likely to cause an appreciable adverse effect on competition within India.

To promote and sustain an enabling competition culture through engagement and enforcement that would inspire businesses to be fair, competitive and innovative; enhance consumer welfare, and support economic growth. 

Sought information

CPIO may provide the following information to the information seeker pointwise as sought at the earliest or within the stipulated time of 30 days as prescribed under subsection 1 of section 7 of the Right to Information Act 2005.

1-      CCI slaps Rs 1,337.76 cr penalty on Google for unfair biz practices in the Android mobile device ecosystem. Please provide the status of the recovery of this penalty.

2-      Provide a copy of the document exchanged from Google regarding the recovery of the imposed penalty.

3-      Provide the name and designation of the staff executing the recovery of this penalty.

4-      Please provide the measures taken to ensure transparency and accountability during the enquiry against Google.

5-      It was checked that rivals of google are not wreaking vengeance because they could not succeed in the competition. If any such steps were taken, then provide the details.

What is being done by the government behind the screen no one knows? 

The Competition Commission on Thursday imposed a penalty of Rs 1,337.76 crore on Google for abusing its dominant position in multiple markets in the Android mobile device ecosystem.

Besides, the fair trade regulator has directed the internet major to desist from unfair business practices. In a release, the Competition Commission of India (CCI) said it has also directed Google to modify its conduct within a defined timeline.

In April 2019, the regulator ordered a detailed probe into the matter following complaints by consumers of Android-based smartphones in the country. Android is an open-source, mobile operating system installed by Original Equipment Manufacturers (OEMs) of Smartphones and Tablets.

The allegations of unfair business practices pertained to two agreements -- Mobile Application Distribution Agreement (MADA) and Anti Fragmentation Agreement (AFA) -- which were entered into by the OEMs of Android OS with Google.

In the release, the regulator said it has imposed a penalty of Rs 1,337.76 crore on Google for abusing its dominant position in multiple markets in the Android mobile device ecosystem apart from issuing the cease-and-desist order.
