I have perused the allegations made in the complaint of complainant Yogi M. P. Singh dated 17.05.2022.

No useful purpose would be served in keeping the present complaint pending. Keeping in view the nature of allegations made in the complaint it would be appropriate to send a copy of the complaint to the Senior Superintendent of Police, Prayagraj who shall look into the matter and do the needful in accordance with law at his end within a period of six weeks from the date of receipt of this order and intimate compliance to the Commission within a week thereafter. I have not expressed any opinion on the merit of the complainant’s case.

If the concerned officer fails to take any action in compliance of this order complainant will be at liberty to approach the Commission fresh.

Subject to the above observations the complaint is finally disposed of.

Subject Police is not registering F.I.R. in the case concerning humiliation of a lady and her younger brother by the proprietor of the Sahara Nursing Home situated at Gauhaniya, Banda Road, District-Prayagraj, Uttar Pradesh. 

Honourable Sir,                                   

                        Here deponent cum pledger affirms as follows. 

1-Regarding inaction of the Ghoorpur police station in registering F.I.R. against the atrocity perpetrated by the proprietor of Sahara Nursing home on Vandana Singh and his younger brother at Gohania, Prayagraj. More detail is attached to the complaint. 

घूरपुर थाना द्वारा एफ0आई0आर0 दर्ज करने में निष्क्रियता बाबत गोहनिया, प्रयागराज में वंदना सिंह और उनके छोटे भाई पर सहारा नर्सिंग होम के मालिक द्वारा किए गए अत्याचार के खिलाफ 

2- Here entire evidence and video clips were made available to concerned police and a signed request submitted by Vandana Singh itself on the advice of circle officer Karchhana. Whether police after registering F.I.R. under the u/s 154 of the Cr.P.C.. summoned Vandana Singh to record the statement under the following section  of The Code Of Criminal Procedure, 1973,

3-Central Government ActSection 160 in The Code Of Criminal Procedure, 1973,160. Police officer' s power to require attendance of witnesses.

(1) Any police officer, making an investigation under this Chapter may, by order in writing, require the attendance before himself of any person being within the limits of his own or any adjoining station who, from the information given or otherwise, appears to be acquainted with the facts and circumstances of the case and such person shall attend as so required: Provided that no male person under the age of fifteen years or woman shall be required to attend at any place other than the place in which such male person or woman resides.

(2) The State Government may, by rules made in this behalf, provide for the payment by the police officer of the reasonable expenses of every person, attending under sub- section (1) at any place other than his residence.

4-Whether the lackadaisical approach of the concerned sub inspector, chauki Gauhaniya and circle officer, Karchhana, quite obvious from his attached report dated 28 April 2022 is justified in the case of atrocity perpetrated by the proprietor of Sahara Nursing home. 

5- प्राप्त फीडबैक -दिनांक21-04-2022 को फीडबैक:-थानाध्‍यक्षप्रभारी नि‍रीक्षकघूरपुर,जनपदप्रयागराज ,पुलिस आप की रिपोर्ट बहुत ही चौकाने वाली है कॅश मेमो रिसीप्ट से स्पस्ट है मरीज विश्वम सिंह सहारा नर्सिंग होम में तीन अप्रैल २०२२ को एडमिट हुआ तथा आठ अप्रैल २०२२ को प्रार्थिनी के अनुनय विनय पर डिस्चार्ज किया गया प्रार्थिनी और उसके भाई को इस लिए बेइज्जत किया गया क्योकि वे मनमाने प्रभारो का विरोध कर रहे थे उसका वीडियो क्लिप गौहनिया पुलिस चौकी इंचार्ज जो की प्रकरण में जांच अधिकारी भी है को उपलब्ध करा दिया गया है उनके द्वारा यूज़ किया गया मोबाइल नंबर ९५५५३२८७२५ जिस पर व्हाट्स ऍप चलता है उस पर भेजा हुआ है जिस लिंक को उन्होंने देखा भी है महोदय ४७२१६ रुपये आठ दिन के इलाज का है जांच अधिकारी श्री मिश्रा जी जब पांच ही दिन इलाज हुआ है तो आप छह और आठ दिन की बात क्यों कर रहे है श्री मान जी जब आठ से छह दिन करने में इतनी बेइज्जत हुई वंदना सिंह तो जान बची लाखो पाए लौट के बुद्धू घर पर आये श्री मान जी वीडियो को देखिये गौहनिया में पुलिस का राज है या सहारा नर्सिंग होम के मालिक का राज है श्री मान जी तीन हजार रुपये प्रति दिन बेड का चार्ज है अर्थात नौ हजार यही घट गया १ हजार पर प्रति दिन डॉक्टर का चार्ज है तीन हजार वही घट जाएगा अर्थात १२ हजार सीधे घट जाएगा शिकायत के साथ रशीद लगा हुआ है चुकी इस फीडबैक के साथ प्रकरण वरिष्ठ अधिकारी को प्रेषित हो जाएगा इस लिए वे अपना व्हाट्स ऍप नंबर उपलब्ध करा दे जिससे उनको वीडियो क्लिप उपलब्ध करा दिया जाय

This is a humble request of your applicant to you, Hon’ble Sir, how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy.
