Subsection 1 of section 19 of Right to Information Act 2005 states as follows.
Any person who, does not receive a decision within the time specified in sub section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by a decision of the Central Public Information Officer or State Public Information Officer, as the case may be, may within thirty days from the expiry of such period or from the receipt of such a decision prefer an appeal to such officer who is senior in rank to the Central Public Information Officer or State Public Information Officer as the case may be, in each public authority:
Provided that such officer may admit the appeal after the expiry of the period of thirty days if he or she is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.
Here it is quite explicit that the First Appellate Authority must be a senior rank officer of public information officer but here ARVIND MOHAN (L.S. Sec-5) Designation UNDER SECRETARY is the both PIO and FAA which is contrary to explicit provision of Right to Information Act 2005.
Continuation of the aforementioned officer at the post of First Appellate Authority is the signal of the lawlessness and anarchy in the working of the office of chief minister government of Uttar Pradesh.Nomination of the Arvind Mohan as the First Appellate Authority implies no remedy available against the arbitrary decisions of the public information officer.
If the efficient officers are available, then why is a man of doubtful integrity being promoted by the office of chief minister of Uttar Pradesh?
Corruption is proved in two ways.1-Through direct evidences. 2-Circumstantial evidence.
Here ample circumstantial evidence questions the integrity of the aforementioned officer reaping the benefits of various key posts.

श्रीमान जी प्रार्थी की शिकायत तो उपसचिव अरविंद मोहन जोकि मुख्यमंत्री योगी आदित्यनाथ जी के कार्यालय में तैनात हैं और जो इस समय मुख्यमंत्री कार्यालय में जन सूचना अधिकारी प्रथम अपीलीय अधिकारी और वेबमास्टर जनसुनवाई पोर्टल है उनके विरुद्ध यह शिकायत की गई है सब कुछ जानते हुए भी मुख्यमंत्री कार्यालय द्वारा मेरे शिकायत को मिर्जापुर जनपद में भेज दिया गया अपर जिला मजिस्ट्रेट द्वारा स्पष्ट रूप से लिखा गया है कि मामला जिला प्रशासन से संबंधित नहीं है बल्कि शासन से संबंधित है प्रश्न गत प्रकरण यह है कि कोई भी जन सूचना अधिकारी उसी कार्यालय में प्रथम अपीलीय अधिकारी नहीं हो सकता है यह न्याय के नैसर्गिक सिद्धांत के विरुद्ध है यह प्रकरण सूचना से संबंधित नहीं है बल्कि सरकार की अराजकता से संबंधित है इस शिकायत के द्वारा मुख्यमंत्री कार्यालय में व्याप्त अराजकता का विरोध किया गया है और यह अनुरोध किया गया है कि इस अराजकता को मुख्यमंत्री कार्यालय से शीघ्र दूर किया जाए यदि मुख्यमंत्री कार्यालय में ही अराजकता होगी तो अधीनस्थ कार्यालयों की विश्वसनीयता का अंदाजा लगाया जा सकता है

अपर जिला मजिस्ट्रेट द्वारा स्पष्ट रूप से लिखा गया है कि मामला जिला प्रशासन से संबंधित नहीं है बल्कि शासन से संबंधित है प्रश्न गत प्रकरण यह है कि कोई भी जन सूचना अधिकारी उसी कार्यालय में प्रथम अपीलीय अधिकारी नहीं हो सकता है यह न्याय के नैसर्गिक सिद्धांत के विरुद्ध है यह प्रकरण सूचना से संबंधित नहीं है बल्कि सरकार की अराजकता से संबंधित है इस शिकायत के द्वारा मुख्यमंत्री कार्यालय में व्याप्त अराजकता का विरोध किया गया है और यह अनुरोध किया गया है कि इस अराजकता को मुख्यमंत्री कार्यालय से शीघ्र दूर किया जाए यदि मुख्यमंत्री कार्यालय में ही अराजकता होगी तो अधीनस्थ कार्यालयों की विश्वसनीयता का अंदाजा लगाया जा सकता है
ReplyDelete, सोचिए जन सूचना अधिकार 2005 के तहत अरविंद मोहन को मुख्यमंत्री कार्यालय में जन सूचना अधिकारी नामित किया और उन्हीं को प्रथम अपीलीय अधिकारी भी नामित कर दिया अर्थात अरविंद मोहन ही अपने नियमों के विरुद्ध अपील को सुनेंगे जो देखने में ही उचित नहीं प्रतीत हो रहा है और इसके अलावा खुद ही जन सूचना अधिकार 2005 के उप धारा 1 धारा 19 के तहत प्रथम अपीलीय अधिकारी वह लोकसेवक होता है जो जन सूचना अधिकार के तहत नामित जन सूचना अधिकारी से पद वरीयता में श्रेष्ठ हो
