* Prayer or Relief Sought Uttar Pradesh Shasan Prashasnik Sudhar Anubhag-2 NOTIFICATION No. 544/43-2-2015-Su.Aa.Ni. 2015(1)2015 Lucknow: Dated 03 December, 2015 which is known as UTTAR PRADESH RIGHT TO INFORMATION RULES, 2015According to point 3 subsection 2 b of section 4 states as follows.Any request for obtaining information under the Act should fulfil thefollowing conditions:The information sought should not involve providing answers to hypothetical questions.Sought information is 1-Registration Number SPMZR/R/2021/60029 Name Sudarshan Maurya Date of Filing 03/08/2021, you had to provide reason of not attaching the reply of APIO sent in the matter to information seeker on the RTI portal therefore information seeker sought reason required under subsection 1 d of section 4 of R.T.I. Act 2005.of government of Uttar Pradesh providing facilities to information seekers online in easy way as accomplishment of government.Now you have arbitrarily attached aforementioned denial dated 01-Dec-2021 on 13/12/2021 while factual position is that you have provided different reply to the information seeker earlier and did not attach that reply actually made in the matter.Whether police department will run with such arbitrariness and tyranny. The matter will be taken up before commission as PIO/Nodal officer took under teeth provisions of RTI Act 2005 ipso facto. 2-Whether police has not fabricated the information seeker under section 107/116 without any solid reason with sole aim to harass the information seeker. Every just work has reason and unjust work is without reason. 3=Whether police concerned not requested city magistrate to nominate technical expert to look into matter as police was not so expert. Whether it is imagination of the information seeker. 4-Report of the Executive Engineer municipality Mirzapur city dated-09-09-2021 is the imagination of the information seeker. When police had not to take any action in the matter then why it troubled city engineer, executive officer Municipality Mirzapur or expected that they will also speak the langage of wrongdoer contractor like police.

* Description of Information Sought 1-My first point information concerns the working of PIO in the office of superintendent of police as follows.Registration Number SPMZR/R/2021/60029 Name Sudarshan Maurya Date of Filing 03/08/2021 Detail is attached.Registration Number SPMZR/A/2021/60018 Name Sudarshan Maurya Date of Filing 16/09/2021 Detail is attachedCircle Officer Prabhat Ray sends its communication containing misleading and incomplete information on 26/10/2021 with report of Chauki in-charge Bali Maurya dated 21/10/2021 falsely justifying its illegal stand instead of submitting arbitrary and inconsistent report instead of focussing on providing sought information to the information seeker as sought under 3 points registered on the RTI portal as SPMZR/R/2021/60029.PIO may provide information as reason of not attaching the reply of APIO on the RTI portal required under subsection 1 d of section 4 of R.T.I. Act 2005.of government of Uttar Pradesh providing facilities to information seekers online in easy way as accomplishment of government.
2-Please provide the reason as required under subsection 1 d of section 4 of the Right to Information Act 2005 to fabricate information seeker under Cr.P.C. 107 /116. Please take a glance of first page of attached PDF which is report submitted by the Chauki in-charge Mandi samiti in the following complaint on the Jansunwai portal. Aforementioned information not provided by C.O. City quite obvious from attached document so he may be directed to provide information.
3-Please provide the progress report in the matter as Chauki in charge requested city magistrate to appoint technical expert to ascertain the loss occurred to information seeker because of dereliction of accused contractor. Aforementioned information not provided by C.O. City quite obvious from attached document so he may be directed to provide information.
4-Report of the Executive Engineer municipality Mirzapur city dated-09-09-2021 is attached to the representation as page 3 of the attached PDF document to this representation as well as this report received by the office of the office of the chauki in charge and office of Kotwal, Kotwali Katra District-Mirzapur. Circle officer City, Prabhat Ray had promised in its office located in police line to take action in the matter after the report of Executive Engineer municipality Mirzapur city when applicant met him in regard to matter on 07 Aug 2021 afternoon aongwith social worker Yogi M. P. Singh.Provide notings on the aforementioned report, action taken report if no action was taken provide reason of not taking any action on the report.
