* Prayer or Relief Sought Sub divisional magistrate Sadar has made a trend to conceal information from the information seekers consequently he is not entertaining any RTI request submitted by the information seekers. Publicly he did not give his contacts like Telephone Number:- , Email Id:- which is not only mockery of the Right to Information Act 2005 but also tantamount to indiscipline.

According to subsection 1 of section 7 of the Right to Information Act 2005-Subject to the proviso to subsection (2) of section 5 or the proviso to subsection (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9:It is 03 October 2021 today which means 1 month 15 days passed, but PIO did not provide any information which means PIO denied information as quite obvious from the subsection 2 of section 7 of the Right to Information Act 2005 If the Central Public Information Officer or State Public Information Officer, as the case may be, fails to give decision on the request for information within the period specified under subsection (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall be deemed to have refused the request.  Consequently, PIO violated subsection 1 of section 7 of the Right to Information Act 2005. Since the matter concerns deep-rooted corruption, therefore the public information officer of the public authority Tahsil Sadar under administrative control of S.D.M. Sadar only played the cunning tricks to conceal information so that corrupt staffs of the public Authority may be shielded.  Here corruption is visible to the public functionaries but not taking any action and also taking under teeth the provisions of the Right to Information Act 2005. Ipso facto subsection 1 of section 7 of the Right to Information Act was violated by the sub divisional magistrate sadar but who cares of it in this anarchy.

* Description of Information Sought Communique concerned to S.D.M. Sadar. Everyone knows that proceedings under Section 107/116. of the Cr. P.C. are only preventive measures and not pure criminal proceedings, but such proceedings are of quasi judicial nature. D.G.P. office is the monitoring head of department of police in the state of Uttar Pradesh through which state government monitors and ensures the law and order in the state. It is the foremost responsibility of the D.G.P. office to safeguard the rights of people and curb the misuse of provisions of law of land. 

It is also the duty of the executive magistrates to take precautionary measures before serving the notice to the people under section 107/116 of criminal penal code against whom police alleging apprehension of breach. 

1-Whoever seek redressal of their grievances by submitting online applications on the Jansunwai portal of the government of Uttar Pradesh, concerned sub-inspector fabricate them under Section 107/116. of the Cr. P.C in most of the cases.

Please provide the measures taken by the S.D.M. Sadar office to curb the misuse Section 107/116. of the Cr. P.C. including copy of the communications issued through the office under its jurisdiction.   

2-S.D.M. Sadar may provide the total number prayers cum cases made by police in the last and current financial year and also the number cases rejected by the S.D.M. Sadar by the application of mind. 

3-Here information seeker seeks the information concerned with G.D. Number-052 dated 03/06/2021 Time 19:18 of Vindhyachal police under Tahsil Sadar. For more detail, vide attached document. 

a-Provide the detail of the second party members whom magistrate served notice and also detail of those who furnished bond before executive magistrate. 

b-Provide the copy of charges with minutes of proceedings made against widow Sugun Singh and her two sons Atul Singh and Nitin Singh. c-Whether maintainability of the charges were checked by the executive magistrate concerned.
