Report of police officer on completion of investigation

Description

Every investigation under this Chapter shall be completed without unnecessary delay.

1A. The investigation in relation to an offence under sections 376, 376A, 376AB, 376B, 376C, 376D, 376DA, 376DB or 376E of the Indian Penal Code shall be completed within two months1 from the date on which the information was recorded by the officer in charge of the police station.

Please provide the information regarding the non arrest of accused Hritik Ranjan.

4-Undoubtedly it may be Lanka police may not have sent the requisite information but when concerned officers have sought information from aggrieved then it is their obligation to take him under custody but Hritik Ranjan still hatches conspiracy against the information seeker knowingly not supporting Lanka police in the investigation. Please provide the reason for not arresting the accused.

* Prayer or Relief Sought Respected first appellate authority with great regard appellant draws the kind attention to the following points. 

1-R.T.I. request received in the office of chief minister online on 07/04/2021 and PIO concerned transferred it to DGP office under subsection 3 of section 6 of the Right to Information Act 2005 on 14/07/2021 as the matter was closely connected to department of police.

2-R.T.I. request received in the office of Director General of police online on 14/07/2021 and PIO concerned transferred it to the office of police commissioner Varanasi under subsection 3 of section 6 of the Right to Information Act 2005 on 24/07/2021 as the matter was closely connected to the office of police commissioner Varanasi.

3-R.T.I. request received in the office of commissioner of police Varanasi online on 24/07/2021 and PIO concerned forwarded it to the office of Assistant police commissioner Bhelupur, Varanasi under subsection 3 of section 6 of the Right to Information Act 2005 on 28/07/2021 as the matter was closely connected to the office of Assistant police commissioner Bhelupur Varanasi.

4-It is 04 Aug 2021 today which means stipulated 30 days prescribed time under subsection 1 of section 7 of the Right to Information Act 2005 to provide information exhausted and assistant police commissioner Bhelupur Varanasi did not provide information to the information seeker.

5-Ipso facto obvious that assistant police commissioner Bhelupur, Varanasi Mr. Chakra Pani Tripathi violated subsection 1 of section 7 of the Right to Information Act 2005.

Please initiate disciplinary proceedings against the assistant police commissioner Bhelupur, Varanasi Mr. Chakra Pani Tripathi and provide information to the information seeker at the earliest. For this, the appellant shall ever pray you, Honourable Sir.

* Prayer or Relief Sought Here it is quite obvious that Concerned PIO CHAKRAPANI TRIPATHI - CO BHELUPUR by not providing sought information to the information seeker still violated the subsection 1 of the section 7 of the Right to Information Act 2005. Information seeker submitted R.T.I. Application on 29/06/2021 and today is 17/08/2021 which means 49 days passed since the date R.T.I. Application received in the office of the public authority SENIOR SUPERINTENDENT OF POLICE OFFICE, VARANASI. Sir, stipulated time to provide information to the information seeker under subsection 1 of the section 7 of the Right to Information Act 2005 is 30 days and herein this matter, public information officer aforementioned could not provide information within 49 days. At least he had to provide the reason for failure to provide information to the information seeker, but he took under teeth the provisions of the R.T.I. Act 2005 ipso facto. It is the obligatory duty of the first appellate authority to direct the public information officer to provide the sought information to the information seeker at the earliest and recommend disciplinary action against him as required under the law of land.
