* Description of Information Sought The information seeker is seeking information from the public information officer in the office of superintendent of police district-Mirzapur, Uttar Pradesh on behalf of Mahima Singh D/O Dayanand Singh. An application under Article 51 A of the constitution of India to make inquiry concerning the fraud of Rs.53000 by the fraudulent elements from the account of the applicant opened in the State Bank of India. Which is quite obvious from the first page of the attached pdf document. It is quite obvious from the attached documents which are the reports of the concerned police in the matter. they are taking action in the matter without registering the first information report and not registering the first information report even after repeated requests of the applicant. Public information officer must provide the following information to the information seeker point wise as follows.
1- This matter of the cyber fraud occurred in the month of August 2023, and it is 8th February 2024 thus 5 months passed but concerned police personnel did not register first information report in the matter.
Right to reason is the indispensable part of the sound administrative system quoted by Supreme Court of India in its numerous judgments so public information officer must provide reason of not registering the first information report in the matter.
2- In numerous grievances of the aggrieved applicant police submitted the report quite obvious from the attached documents in which police assured that police is taking action in the matter but the prayer made by the applicant to register the first information report which is essential ingredient to proceed in a matter by the police as required under criminal procedure code.
Please provide the provision of the criminal procedure code which is followed by the police in criminal matter without registering the first information report.
3- It is quite obvious that more than five months passed but the concerned company and bank did not respond to the police and police is assuring the aggrieved applicant that it will take action after the response of the company.
Please provide the time taken by the police in sending the email, awaiting response of the email and reminding emails if not responding the emails to the cyber offenders for taking further action in the matter.
4- Please provide the name and designation of the staff of the cyber cell Mirzapur who are taking action in the matter as reported in various reports of the police attached to the application.
5- Please provide the benefits being reaped by the police by not registering the first information report in the matter of cyber fraud which is quite obvious from the procrastination of the concerned police for longer.
