Matter concerning non-appointment of information commissioners in Uttar Pradesh informed to the Supreme Court of India

Regarding the filling of post of information commissioners in Uttar Pradesh state information commission.

An application under article 32 of the constitution of India regarding entire posts of Information Commissioners in Uttar Pradesh state information commission is lying vacant currently and no arrangement made by the state government.

The current status of the members of state information commission government of Uttar Pradesh is as follows.

6th February, 2021.

The State Chief Information Commissioner and the State Information Commissioners shall be

appointed by the Governor on the recommendation of a committee consisting of—

(i) the Chief Minister, who shall be the Chairperson of the committee;

(ii) the Leader of Opposition in the Legislative Assembly; and

(iii) a Cabinet Minister to be nominated by the Chief Minister

Provided further that where the State Information Commissioner is appointed as the State Chief

Information Commissioner, his term of office shall not be more than five years in aggregate as the State

Information Commissioner and the State Chief Information Commissioner.

The applicant is making inquiry under article 51 a of the Constitution of India from the government of Uttar Pradesh under supervision of the Apex Court of India for the protection of Fundamental and Human rights of the citizens which is the Guardian of the Constitution of India and non-appointment of the information commissioners timely in the state information commission paralysed the functioning of the Uttar Pradesh state Information Commission.

1- It is quite obvious that 6 posts of the state information commissioners are lying vacant in the Uttar Pradesh state information commission. Which means entire functions of the state information commission have been paralysed.

Please provide the copy of communications exchanged with the chief information commissioner regarding to fill the vacancy of the state information commissioners in the Uttar Pradesh state information commission.

2-Please provide the copy of communications exchanged with the Office of Her Excellency regarding to fill the vacancy of the state information commissioners in the Uttar Pradesh state information commission.

3- Please provide the feedback regarding the notification issued to fill the vacancy of the state information commissioners lying back because of the retirement of the existing state information commissioners.

4- Please provide the information regarding the ad hoc arrangement made by the government till the filling of the vacancies of the state information commissioners till the completion of the procedure of Appointment of the information commissioners in the state.

5- Please provide the duration, till the entire function of the Uttar Pradesh state information commission will be performed by the chief information commissioner without state Information Commissioners.

Most respected sir please restore the rights of the people in the state provided by the constitution of India and the parliament of this country in the form of right to information act 2005 because non appointment of the state information commissioners has disrupted the entire proceedings concerning the second appeals in the Uttar Pradesh state Information Commission. 

Usually the bureaucrats in the state of Uttar Pradesh play various cunning tricks not to provide information to the citizens in state but currently they have paralysed by not appointing the state information commissioner timely and if it would not be taken into account this disruption of the state information commission will remain continue.

This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.
