The matter concerns unsigned and without date report submitted is quasi-judicial proceedings in the working of SDM Sadar which lacks transparency and accountability. Please tell the applicant whether such reports are allowed under the law.

The copy attached to the grievance is a rough copy provided by the Lekhpal to the applicant. It is most unfortunate that the concerned staff of tehsil Sadar submitted the same parrot report which is arbitrary and inconsistent to the submitted contents of the grievance. It seems that office bearers of Tehsil Sadar are governed by rule of anarchy ipso facto from working style. Corruption cannot be tolerated. Right to reason is the indispensable part of the sound administrative system quoted in various judgements of apex court concerned Lekhpal must tell the reason for not writing the date of the submission of the report and cause for not signing the report. You can also tell the applicant that unsigned without date reports are submitted in quasi-judicial courts in this largest democracy in the world.

Corruption has 2 types of evidence. The first type is direct corruption which has direct evidence. The second type of corruption is indirect corruption which is proved with the help of circumstantial evidence. Undoubtedly in this matter there is no direct evidence of corruption, but circumstantial evidence is proving indirect corruption. Here the matter concerns the compliance of the court order which is an administrative matter, moreover lekhpal is not a quasi judicial body.

The matter concerning the compliance of the order passed by the respected court and instead of providing explicit reply in the matter concerned Lekhpal provided a cryptic report to close the grievance which is showing arbitrariness and tyranny in the working of the tehsil Sadar. Whether the concerned Lekhpal verifies the attached report that he has submitted this report before the court then tell me the date to the applicant because this copy is the rough copy provided by the Lekhpal. Whether the report submitted by the Lekhpal in the court of sub divisional magistrate without date and signature? It is quite obvious that the attached report does not contain the date and signature of the Lekhpal. Any report submitted before the court contains the signature and a date of submission and after that report is considered authentic, but these things are absent in the attached report. Right to reason is the indispensable part of the sound judicial system as well as sound administrative system therefore concerned Lekhpal must provide the reason for not providing signature and not mentioning the date of the submission of the report. Here the applicant is not talking about the processing of the court but making efforts regarding the compliance of the order made by the most respected court. The efforts of the applicant will only accelerate the process of the court which is the need of the hour.

The matter concerns the order passed by the sub divisional magistrate Sadar Mr. Chandra Bhanu Singh on 01 August 2021 in the case Jagdish Prasad versus Ganesh Prasad and others filed under section 116 of the Revenue Code 2006. According to order passed by the honourable subdivisional magistrate, concerned Lekhpal was directed that in Araji number-91 which measurement is 0.329 hectare located in village-Sohta, Tappa-84, pargana-Kantit, tehsil-Sadar, Mirzapur, share decided by the Honourable court must be partitioned. Honourable Sir may be pleased to take the perusal of the attached order of the court.

The brief description of the grievance may be summarised as follows.

1-It is quite obvious that most respected subdivisional magistrate Chandra Bhanu Singh passed this order on 01 August 2021, and it is 01 December 2023 today which music two years four months passed since the date of order, but no action was taken by the concerned staff of the Tehsil Sadar.

2-Whether the concerned Lekhpal will tell the applicant reason of non-compliance of the order passed by the most respected subdivisional magistrate Chandra Bhanu Singh.

3-Whether any other order passed by the competent court to nullify this order, if passed please tell the details to the applicant.

4-Concerned Lekhpal must tell the activities which was carried out by him in that direction for the compliance of the order passed by the competent court as aforementioned.

5-Whether the communication regarding the compliance of the order passed by the court was not exchanged with the Lekhpal must be told by the Lekhpal to the applicant.

6-Whether it is not reflecting the tyranny and arbitrariness in the working of the Lekhpal concerned who took under teeth the order passed by the most respected court ipso facto obvious.

7-Whether such mysterious and cryptic activities of the Lekhpal concerned is not reflecting corruption in the working because there is no transparency and accountability in the compliance of the order passed by the monitoring head. As well as there is no fear in the mind of the subordinates when they do not comply the orders.

This is a humble request of the applicant to the most respected Sir to order an inquiry into the matter so that truth may come out of this
