Grievance Description

The matter concerns the working of the district Magistrate Mirzapur who did not make compliance of the order passed by the Uttar Pradesh State Information Commission which is tantamount to indiscipline.

This matter concerns the recovery of rupees 25,000 from the Basic Shiksha Adhikari Mr Amarnath Singh imposed by Uttar Pradesh state information commission which has not been complied in five years.

The matter concerns the non-compliance of the order passed by Uttar Pradesh state information commission in the matter appeal number-S-11-856/C/2010, Registration number-233952.In this case/appeal the appellant was the applicant, and the opposite party was Basic Shiksha Adhikari Mr Amar Nath Singh District-Mirzapur.

Short submissions of the applicant are as follows.

1- The first page of the attached PDF document is the communication of the Registrar Uttar Pradesh State Information Commission addressed to the District Magistrate Mirzapur dated- 7th February 2024. Which is the reminder to make compliance of the order passed by the Uttar Pradesh state information commission.

2- The second page of the attached PDF document is the communication of the in charge of the penalty section, Ms Sushma Pal of the Uttar Pradesh state information commission addressed to the Registrar Uttar Pradesh State Information Commission dated- 7th February 2024.

3- The third page of the attached PDF document is the communication of the Registrar Uttar Pradesh State Information Commission addressed to the District Magistrate Mirzapur dated 30th November 2018.

4-The fourth and fifth pages of the attached PDF document is the Order passed by the most respected member/Honourable information commissioner of the Uttar Pradesh state information commission Mr Gajendra Yadav in the appeal of the applicant.

5- From the third page of the attached pdf document it is quite obvious that the concerned district magistrate had to make the compliance of the order passed by the Uttar Pradesh State Information Commission in the matter within three months from the date of receipt of the order of the respected commission.

6- It is to be submitted before the most respected Sir more than five years passed but the compliance of the order passed by the most respected Uttar Pradesh state information commission was not made by the district Majestic Mirzapur which reflects the rule of anarchy in the working of the district Magistrate.

First of all, it is noticeable that this matter does not concern with the working of the basic Shiksha Adhikari because it is concerned with the compliance of the order passed by the Uttar Pradesh state information commission and a reminder was sent by the Uttar Pradesh state information commission through its registrar to the district Magistrate Mirzapur for the compliance of the order. The matter concerns the working of the district magistrate Mirzapur itself as well as Treasury officer district Mirzapur who works under the supervision of the district Magistrate Mirzapur. Think about the gravity of situation first letter sent by the Uttar Pradesh state information commission in that year 2018 and this reminder was sent by the registrar of Uttar Pradesh state information commission after six years i.e. in 2024. When the order passed by the Uttar Pradesh state information commission is not complied by the district magistrate then think about request of common people in the district.

  1. Think about the gravity of situation department of administrative reform issued guidelines regarding the recovery of penalties from the erring public information officers imposed by the Uttar Pradesh state information commission.

It is quite obvious that order was made available by the Uttar Pradesh state information commission through its registrar to the district magistrate Mirzapur in 2018 and it is 2024 which means 6 years passed, but the compliance of the order was not made available to Uttar Pradesh state information.

  3. It is most unfortunate that former basic Shiksha Adhikari Amarnath Singh is posted as district inspector off school Mirzapur but district magistrate Mirzapur could not insure recovery of Rs.25000 from his salary reflects Jungle rule in the district Mirzapur.
