of energy to public authority Uttar Pradesh Power Corporation Limited as

2-From the following status of the
rti application it is quite obvious that RTI application transferred to the
other public authority Purvanchal Vidyut Vitran Nigam Limited on 21/10/2023 and
on 02/12/2023 to executive engineer electricity distribution division 2nd Mr
Rajesh Kumar on second December 2023 and it is 17th January 2024 which means
one month 16 days passed but executive engineer did not entertain the RTI
application of the appellant which is the violation of subsection one of
section 7 of the right to information act 2005.

the information seeker at the earliest as well as please initiate disciplinary
proceedings against him for violating the provision of right to information act
2005.

information sought by the appellant from the public information officer in the
Department of energy government of Uttar Pradesh.

information regarding the misuse of office memo dated 25th September 2021 which
was retrospected by Executive Engineer EDD second district Mirzapur Mr Rajesh

Reply :- अवगत कराना है कि आपका आनलाइन आर0टी0आई0 पत्र संख्या-DOCMO/R/2023/60680 तत्समय पूर्ण रूप से कम्प्यूटर पर प्रदर्शित न होने के कारण
मांगी गयी सूचना अस्पष्ट होने का उल्लेख करते हुए निस्तारण किया गया था, प्रथम अपील प्राप्त
होने पर यह स्पष्ट हुआ कि आपका प्रकरण ऊर्जा विभाग से सम्बन्धित है। आनलाइन आर0टी0आई0 पूर्व में निस्तारित
हो चुकी है जिसे अन्तरित नही किया जा सकता तथा आनलाइन प्रथम अपील को अन्तरित किये
जाने का विकल्प नही रहता है, अत: कृपया धारा-6(1) के अन्तर्गत ऊर्जा विभाग से सीधे सूचना प्राप्त करें अथवा मुख्यमंत्री
कार्यालय को पुन: आवेदन प्रस्तुत कर सकते है। इसे सम्बन्धित को अन्तरित किया जा
सकें। एतदद्वारा प्रथम अपील निस्तारित की जाती हैा
The crop of the
Dayanand Singh son of Shobhnath Singh was burnt on 18th April 2021 due to short
circuit. The report was submitted by the concerned Lekhpal on 15th June 2021
which was forwarded by the Kanungo and 19th June 2021. Here it is quite obvious
that the circular issued by the Uttar Pradesh Power corporation limited is of
later date and there is too much time interval. How can Executive Engineer Electricity
Distribution division second mister Rajesh Kumar can do the retrospection by
applying office memo of later date?

पावर कारपोरेशन का उपरोक्त कार्यालय मेमो 25 सितंबर 2021 को आया जबकि दयानंद की फसल 18 अप्रैल 2021 को जली उस समय यह ऑफिस मेमो अस्तित्व में नहीं था फिर अधिशासी
अभियंता विद्युत वितरण खंड द्वितीय श्री राजेश कुमार किस शासनादेश के आधार पर
दयानंद सिंह से एफ आई आर की कॉपी मांग सकते हैं क्योंकि उस समय तो ऐसा कोई
शासनादेश नहीं था क्योंकि उपरोक्त कार्यालय मेमो की तिथि 25 सितंबर 2021 है
2-अपर मुख्य सचिव/प्रमुख
सचिव/सचिव -ऊर्जा विभाग उस शासनादेश या परिपत्र की प्रतिलिपि उपलब्ध कराएं जिसके
आधार पर उन्होंने कार्यालय मेमो के सिंहावलोकन की अनुमति दी
3-जन सूचना अधिकारी
मुख्यमंत्री कार्यालय उस दिशा निर्देश की प्रतिलिपि उपलब्ध कराएं जिसके अनुसार कोई
अधिकारी या कर्मचारी विभाग द्वारा जारी किए गए शासनादेशों परिपत्रों का सिंहावलोकन
कर सकता है जैसा कि अधिशासी अभियंता विद्युत वितरण खंड द्वितीय मिर्जापुर द्वारा
किया गया और उसको मुख्यमंत्री कार्यालय ने स्वीकार किया
उपरोक्त तीन बिंदुओं
की सूचना प्रार्थी को जन सूचना अधिकार 2005 के उप धारा 1 धारा 7 में निर्धारित समय
सीमा के भीतर उपलब्ध कराएं
This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy.
