* Prayer or Relief Sought According to rule 25 of high court RTI Act 2006- Central Public Information Officer shall not be liable to provide any information, which can be obtained under the provision of the Allahabad High Court Rules, 1952 in case of High Court and under General Rule (Civil/Criminal) in case of subordinate Courts. This implies that cases in the high court judicature are processed under Allahabad High Court Rules, 1952 And in the lower courts cases are processed under criminal procedure code, if of civil nature then it will be processed under civil procedure code. It simply implies that information concerning the code proceedings will not be provided under the provisions of right to information act 2005.In the matter concerned, the information seeker is seeking information concerning the grievance which is not being processed under any court of law so it must be accessible to the information seeker.It is quite obvious from the quotes of the central public information officer that no action was taken by the high court of judicature on the grievance of the appellant by taking the recourse of the order passed by registrar general of the high court of judicature on 21/03/2023. It is quite obvious that the grievance submitted by the appellant was concerned with the jurisdiction of the district judge Lucknow. Honourable apex court of India on the number of occasions articulated in its judgments that right to reason is the indispensable part of the sound judicial system. They also advocate it for better administration as an ingredient to good governance.It is quite obvious that grievances were submitted to curb the travesty of justice in the lower court but it is most unfortunate that our accountable public staff itself are a stumbling block in the path of a transparent and accountable system quite obvious from cryptic and mysterious dealings. It was the right of the district judge Lucknow to decide the fate of the grievances but it did not reach him and filed in the heap of records in high court of Judicature without taking any action. At the place of noting, the central public information officer may kindly provide the appellant a reason for not taking any action or not forwarding it to the district judge Lucknow as the matter is closely connected to district judge Lucknow. Whether the citizens in the state have no right to cry before the judicial members? Tyranny and arbitrariness always suppress the genuine voices of the public and close the gate of a transparent and accountable system.
