Honourable commission passed the order as follows. Perused the complaint of Yogi M. P Singh. It appears that the complainant's son is an accused in the criminal case. He alleges that he has been falsely implicated in the aforesaid case. The issue regarding the innocence of the complainant cannot be decided by the Commission as the same falls within the domain of investigation. There is no allegation in the complaint that the case is not being investigated fairly. In view of the above I do not find any reason to interfere in the matter. The complaint is hereby rejected.
Short submissions are as follows.
1-Honourable commission did not take the perusal of the matter which is the cause of inconsistent order by the Honourable member.
2-Undoubtedly it is a blunder but it is expected that the error is human.
3-Member of U.P.H.R.C. must know that the matter concerns retrospection of the office memo dated 25 Sept 2021 of UPPCL by the Executive Engineer EDD II which deprived farmers of compensation.
4-Arbitrariness and tyranny of Executive Engineer EDD II Mirzapur Mr. Rajesh Kumar deprived a large number of farmers of compensation whose crops were burnt due to short-circuit during covid 19 period before Circular letter number-2828 dated -25 September 2021. This office memo was retrospectively applied in the cryptic manner instead of subsequent application.
5-Here the matter concerns the circular letter number 2828 dated 25th September 2021 is an office memo of the Uttar Pradesh Power corporation limited. The crop of the Dayanand Singh son of Shobhnath Singh was burnt on 18th April 2021 due to short circuit. The report submitted by the concerned lekhpal on 15th June 2021 which was forwarded by the Kanungo and 19th June 2021. Here it is quite obvious that the circular issued by the Uttar Pradesh Power corporation limited is of later date and there is too much time interval. How can Executive Engineer Electricity Distribution division second mister Rajesh Kumar can do the retrospection by applying office memo of later date? The office memo issued by the Uttar Pradesh Power corporation limited must be applied in matters which are happening subsequently.
Please connect this revision by reviving the aforementioned petition of the petitioner in the interest of justice.
